   Comes now Detective Roland Weiss of the Thurston County Sheriff's   
   Office, who being first duly sworn, on oath deposes and says:

   On July 15th, 2005  William Proffitt reported to the Thurston County   
   Sheriff's Office that he was the victim of Identity Theft and   
   Harassment by an unknown person  who used his internet domain name and   
   on-line e-mail address  (oldsarge@oldsarge.net).   The suspect used   
   obscene language, accused others of sex offenses...   
   On July 2nd, 2005, Mr. Proffitt discovered postings on the Usenet   
   newsgroup  alt.military.retired.  He found a total of at least 163   
   posted messages in which the sender/poster used Pr. Proffitt's e-mail   
   address and domain,  oldsarge@oldsarge.net.   
   These messages included vulgar and obscene comments of a sexual nature   
   directed toward third parties.  The poster accused one person, Richard   
   Greene, of being a convicted child molester, and graphically described   
   sex offenses.   
   The true identity of the poster is not  known.   
   However, one of the unique message identifiers, is:

   Let's take a look at the  THURSTON COUNTY  SHERIFF'S OFFICE "CASE   
   DISPOSITION"   
   Case #05-07110-07,  dated  9/2/2005   
   The "suspect" is in Schertz, Texas.   
   Under  COMMENTS,  the Detective state:   
   "The suspect was warned, and agreed to stop using the victim's domain   
   name, which he has already stopped doing."

   ANOTHER DOCUMENT:  the THURSTON COUNTY SERIFF'S SUPPLEMENTAL REPORT ,   
   dated 9/02/2005,  had the Detective stating that he had received   
   information back from NIBBLE INFORMATION SYSTEMS of Osceola, Indiana.

   On 8/22/2005 the President of Nibble Information Systems sent the   
   Detective a fax confirming the suspect's subscriber's account   
   information.  That location was in Schertz, Texas.  The Detective   
   stated that Mr. Proffitt had stated the abuse had stopped since he had   
   reported it and it was Mr. Proffitt (NOT Rodger Frego) who thought a   
   warning was sufficient.

   The Detective further stated that he contacted the Police department   
   in Schertz, Texas.   
   They provided the name and telephone number of the suspect.   
   The Detective stated that on 9/2/2005 at 0950hrs he telephoned Mr.   
   Frego.   
   The Detective stated that  "Mr. Frego freely admitted he had sent the   
   messages."

   Further:,  Mr. Frego admitted that "He realized the type of messages   
   being sent were getting to be inappropriate.  Mr. Frego assured me he   
   would not continue that activity."

   The Detective further stated:  "I informed him that Identity Theft was   
   a serious crime, and that other forms of harassment might be   
   chargeable in this case.  I told him this was a warning.

   It strongly appears that Rodger Frego has not kept his word to that   
   Detective.   
   It strongly appears that he is again sending vulgar and obscene   
   messages and again making accusations....
