   The death penalty is already constitutional.   
      
   Even the proposed amendment would not prevent a Rose Bird   
   attack.  Bird was the  Chief Justice of the California Supreme   
   Court.  While she never ruled the death penalty unconstitutional,   
   she reversed every death penalty conviction while she was Chief   
   Justice, until she was removed by the voters.
