         The constitution is deliberately ambiguous on whether treaties   
   have equal status with the constitution.   Allegedly the reason is   
   that the founders were afraid that the US might lose a war and have to   
   submit to treaty provisions that were technically-unconstitutional.   
   The ambiguity provides an out to make such provisions legal.  However,   
   To date,  the courts have pretty much ruled that a treaty cannot   
   violate consitutional protections.
