I had anticipated that you would oppose torture, and brought it up as
a supporting argument. Your answer sends shivers down my spine and I
am now sorry to have mentioned it. Please let's skip torture.

Your other replies touch the essence, and the solution lies in plain
   logic.

You CAN die from sex; you DO die from capital punisment. So they are
   different categories.

I am no relativist who says all types of governments are exchangeable.
Democracy is very dear to me. But to decide in practice which
circumstances are suited, and which governments are democratic enough
to apply physical punishment, is an impossible task and will lead to
   numerous abuses.

In all conflicts from ancient times up till today, the various parties
always believed in their own righteousness.

Arithmetically half of them must be wrong. Yet all of them can claim
to be the rightful authority, and to live the special event, that
   allow for physical punishment.

Thus at least half of those punishments will be inadmissable, while
the other half contains a serious percentage of juridical errors.

On the other hand, scientific research has demonstrated repeatedly
that physical punishment has no positive effect on crime statistics at
all. So why should we do what is repulsive and yet unsatisfying? This
is not like sex at all...
