   Phoenix, AZ—This Friday Judge Rosa Mroz will hear arguments on a   
   Motion filed by Debra Milke’s lawyers to disqualify the Maricopa   
   County Attorney’s Office from prosecuting Debra Milke at her   
   retrial.  County Attorney Bill Montgomery is very desperately   
   trying to hang on to the case.  What are his motives?  Is he   
   covering up misconduct?  Could he be afraid of what a new   
   Special Prosecutor may find out?  Does it somehow subvert   
   justice to bring in another prosecutor to handle this mess?   
      
   Montgomery knows there is no case against Milke. It’s painfully   
   obvious now that Saldate fabricated his testimony that Milke   
   confessed to him.  Montgomery does not seem to care that it is   
   more than clear that Milke is innocent.   
      
   The next question is what did former prosecutor Noel Levy know   
   and when did he know it?  Levy has prosecuted two other notable   
   reversed death penalty cases that involved falsified evidence;   
   the David Hyde and Ray Krone cases.  These were major   
   embarrassments and taxpayers already paid millions as a result.   
      
   With the additional exposure of a Maricopa County Prosecution   
   Culture of Corruption scandal eminent, desperate times call for   
   desperate measures.  Prosecutors and their star witness, former   
   disgraced detective, Armando Saldate are currently under   
   investigation by the Justice Department for violating the Civil   
   Rights of Debra Milke.   
      
   Saldate’s hideous law enforcement career has finally caught up   
   with him.  His phony claim that a young mother confessed to him   
   that she arranged to murder her own four year-old son put her on   
   Arizona’s Death Row for nearly 24 years.  The Ninth Circuit U.S.   
   Court of Appeals labeled Saldate as a serial perjurer when they   
   reversed Milke’s convictions and death sentence as they ordered   
   a new trial.   
      
   Saldate’s career began on a sour note when he stopped a female   
   motorist and discovered she was wanted on an outstanding traffic   
   warrant.  Saldate offered the woman freedom in exchange for sex.   
    The woman agreed to meet Saldate in a more private location but   
   immediately contacted authorities.  The Phoenix Police   
   Department began an investigation by interrogating Saldate who   
   claimed the extortion never happened.   
      
   They brought Saldate in for a polygraph examination and he   
   flunked the test.  Soon Saldate confessed to his crime but   
   something amazing happened.  Rather than arrest, prosecute and   
   imprison the admitted felon, they simply gave him a five-day   
   suspension.   
      
   That never interfered with his promotion to the Homicide Bureau   
   as a detective.  My sources told me that a powerful local   
   Democratic politician that controlled the region’s Latino vote,   
   Mary Rose Wilcox, always protected Saldate.   
      
   Saldate has been documented in some 18 cases falsifying   
   confessions.   Rather than interview suspects with tape   
   recorders and have witnesses present he’d set up what are called   
   swearing contests in court.  Saldate would claim under oath that   
   a murder suspect confessed and the suspect would claim Saldate   
   lied.  Who would the jurors believe the policeman of the   
   suspect?  We all know what that answer.   
      
   In 2010 Saldate was working as a Maricopa County Constable.  He   
   was enjoying his Phoenix police pension and double dipping on   
   the county’s payroll.  That is until a woman came forward   
   telling authorities that Saldate offered to extend the time   
   before she’d be evicted by an order he was supposed to serve on   
   her.  The desperate woman surrendered sexually to Saldate.   
   Later the woman went to the authorities and told them what   
   happened.   
      
   When the new extortion investigation spotlighted Saldate and he   
   was interrogated he invoked his right to remain silent through   
   his attorney.  Saldate was able to escape prosecution, trial and   
   imprisonment by simply retiring as Constable.   
      
   Saldate has lost any effectiveness whatsoever as a witness.  If   
   they call him it will be a definite disaster.   Prosecutors   
   tried and failed in court to prevent defense lawyer’s   
   examination of the cop’s sordid past.  Judge Rosa Mroz has ruled   
   that Saldate will have his background exposed to any new jury.   
      
   Montgomery has a Major problem, if Milke walks there is little   
   question she will be making an astronomical tort claim against   
   cops and prosecutors for decades of being shuttered unlawfully   
   on Death Row.   Old wounds will be ripped open where Maricopa   
   County prosecutors have done things to innocent people coasting   
   taxpayers many millions in payouts.  This will have major   
   political fallout and deserved embarrassment.   
      
   Right now confessed killer Roger Scott along with James Styers   
   are in the eleventh hour of appeals and should be meeting their   
   executioner very soon.   Scott of course along with James Styers   
   took Milke’s son out to the desert and shot him in the head   
   three times.  Neither Scott nor Styers ever implicated Milke at   
   her trial.   
      
   It turns out that Bill Montgomery may be a truly a soulless   
   bastard.  He has indicated that he intendeds to give Scott his   
   life back along with freedom but only if he can now tell better   
   lies than Saldate.   Scott never gave any testimony at Milke’s   
   trial.   
      
   Of course Scott was really busy covering up his lies.   
      
   Creating a new version of events after nearly 24 years will be a   
   challenge for Scott who has steadily but unsuccessfully used his   
   various mental defects in order to somehow mitigate his   
   murdering the little boy.   
      
   Apparently Bill Montgomery is willing to stoop to any level to   
   cover up prosecutorial misconduct.  Montgomery does not care   
   that Milke is innocent.  Montgomery is simply out to murder   
   Debra Milke rather than to face the fact that Armando Saldate   
   and possibly members of the Maricopa County Attorney’s staff   
   committed grievous crimes and torts.   
      
   Montgomery has been condemned for his efforts to retry Milke by   
   the media and the ACLU.  Trust me when I say the Human Rights   
   advocates on Geneva, Switzerland have Montgomery in their   
   crosshairs too.  Switzerland’s President, Micheline Calmy-Rey,   
   personally examined me at length about the Milke case the last   
   time I was in Geneva.   
      
   I cannot help but be reminded of history by Montgomery’s   
   actions.  This was exactly the way things worked in a notorious   
   building on Prinz Albrecht Street in Berlin Germany from 1933   
   until 1945.  When the prosecutors wanted you it was always a one-   
   way trip to the guillotine or scaffold.  Perhaps what the   
   Gestapo and Nazi prosecutors have done was more merciful that   
   what they are trying to do to Debra Milke over more than two   
   decades.   
      
   Judges count heavily on the support of prosecutors as they seek   
   retention and elevation to higher courts.  So I have to ask,   
   will Judge Mroz have the courage to disqualify Montgomery and   
   his office from further involvement in the Milke Case?
