   For some reason you deleted the rest of my message in which I explained   
   precisely how the DA prevents the arrest from occurring in real life.   
   Briefly: The DA tells the police that there will be no prosecution. The   
   police therefore have no incentive (in fact, a disincentive, given the cost   
   and the effect on their good bust ratio) to make the arrest.
