   Depends on whether the police have proof that the items were obtained   
   through illegal activity.   
      
   If NOT then the police have no claim to the property as evidence in a   
   crime. They are police who can only do "their" job they aren't NOT STAZI   
   or SS storm troopers or JACK BOOT Fascist Police and Prosecutor and   
   Judge and Jury...  who do it all can confiscate stuff at their own whim.   
      
   If the law allows that then the law is unconstitutional.   
      
   Amendment IV   
   The right of the people to be secure in their persons, houses, papers,   
   and effects, against unreasonable searches and seizures, shall not be   
   violated, *and no Warrants shall issue* , but upon probable cause,   
   *supported by Oath or affirmation* , and particularly describing the   
   *place to be searched*, and the *persons or things to be seized* .   
      
   Which means the police need a warrant to seize, and to get a warrant   
   they have to have evidence of a crime that's sworn under oath or the   
   actual evidence of a crime taking place related to the evidence.   
      
   Warrants for phishing where they go looking for evidence to seize   
   without sworn material witness testimony presented to the court or some   
   evidence of a crime having been committed by the person or in the place   
   being searched.   
      
   When they lie or get someone to lie for them, the police have violated a   
   person's CIVIL RIGHTS.  It's a crime.  The police lose all credibility   
   when they violate laws and RIGHTS of persons, go take a course in   
   ethics.   
      
   Promoting the theft of and invasion by police to grab evidence   
   illegally, makes the police the bigger criminals because when they   
   violate the RIGHTS of a person, they're attacking the RIGHTS of 350
