It will end up in a court       room again at some point.              > Davis violated the “clearly       > established” rights of two       > couples – David Ermold and       > David Moore; and James Yates       > and Will Smith – to marry       > “when she declined to issue       > marriage licenses based on her       > belief that same-sex marriage       > was immoral,” Judge Richard       > Allen Griffin of the Sixth       > Circuit Court of Appeals wrote       > in the brief, five-page opinion.       >              And it isn't law, it's also false... it wasn't clearly established that       Federal judges could rewrite State laws. The judge can find the State       law a violation of the U.S. Constitution, but the judge can't write new       State marriage law. What is the Marriage law once it's been nullified as       unconstitutional by the judge or more correctly, the law is found to be       outside the Jurisdictional power of the States legislature to write that       marriage law (because it was violating the 14th amendment), then it's       all very ambiguous as to what the Legislature wants the county clerk to       do with NON conforming licenses that don't meet current criteria on the       forms. Can she then also marry 3 men or two men and a goat since that's       also NOT a marriage law if the entire Marriage law was no longer in use.                     Until it's re written and passed into law there would be no limits on       State marriages.                     > This is the second time Davis       > lost an effort to claim qualified       > immunity for her repeated,       > unlawful denials of marriage       > licenses.       >       > https://lawandcrime.com/lgbtq/anti-gay-marriage-former-county-clerk-kim-       > davis-loses-bid-for-qualified-immunity-in-lawsuit-brought-by-same-sex-co       > uples-again/       >              All she really needs to do point out in response to any law suit, is       that the judge has no power to make state law and the standing legal       State criteria at that time didn't allow for a license to gays, and       while it wasn't illegal because the entire marriage law making it       illegal was unconstitutional, it was also NOT legal according to state       laws and forms provided to the county clerk.              And until a new State law and State new direction was legally obtained       by her, she would be violating State laws to act outside her       State/county authority. Which means until the Legislature legally       created "gay marriage" as a choice or option or the new law carefully       worded to make it legal under the U.S. Constitution, then it would be       the same as marrying a person to dog, it's NOT legal because there is no       legal option for it. The legal limits of the Legislature would need       clarification to know what unmentioned marriages were either acceptable       on that legal document called a marriage license being issued by the State.              Actually all marriage licenses should have been withheld until the issue       was resolved because the Federal Judge can't remove parts of a State law       and would have to simply declare the entire Marriage law as       unconstitutional, NOT just the "Man and Woman" clause part that's in the       law.              A Federal Judge has no power to select or change a State law. SO the       judge was guilty of violating Kim Davis' Civil Rights when she was held       on contempt charges.              Kim Davis should sue the original Federal Judge who jailed her and try       to have the judge impeached and disbarred. Because the Judge should have       stopped all marriage license issuing in the State, due to the law being       unconstitutional.                            --       --       .       .       .       .       .       .       .       .       .       .       .       .       .       .       .       -That's Karma-              *IF YOU'RE READING THIS YOU ARE A SURVIVOR*       *The first rule of SURVIVAL CLUB* is we talk about it, we hate       censorship.
