   Regardless of what "balance of power" or "checks and balances" you   
   think might have been intended, since the Supreme Court gave itself   
   the role of sole and final interpreter of the Constitution in the   
   Marbury v. Madison decision of 1803, the Constitution says whatever   
   they say it says.
