   CH – 100,Item 6       DESCRIBE HARASSMENT   
      
   Comes now Alan B. Mac Farlane, hereinafter known as the Petitioner.   
   WHEREAS, Petitioner makes this statement hereinall and in the   
   particularities of his averments made as his sworn statements under   
   penalties of perjury under the laws of California, as a Sovereign,   
   holding Primacy of Position, and positively can expect no less from the   
   Respondents known as Jeremy Gardea and Stacy Gardea with their sworn   
   statements.   
      
   The Petitioner states that I have know Jeremy and Stacy Gardea for the   
   past 10 years as my neighbors.  They have constantly used Law   
   Enforcement such as the Sonoma County Sheriff Dept, the California   
   Highway Patrol, the City of Santa Rosa Fire Dept, and supposedly the Bay   
   Area Air Quality District to use agents to harass me with wasted and   
   unnecessary civil actions through out all this time I have known them.   
   This is always about medical marijuana and my lawfull status as a   
   patient under cancer treatment.  Under the law, the medical marijuana is   
   just as consitutionally and legally correct as insulin for a diabetic or   
   asprine for heart problems.   
      
   To date, in the historical record there are two Sheriff Department   
   reports on file.  Case number 080820-016 dated 08-08-08.  This was a   
   case, where Stacy Gardea made a felony crime accusation of a ‘CPS   
   TERROIST THREAT’ against the Petitioner.  This is where the Petitioner   
   stated to Stacy Gardea and later stated to the Sheriff Department that   
   in the event of witnessing child abuse in locking the children in their   
   home alone, I would call CPS, the Sheriff to show them how you take care   
   of these children.  Gary Sosa was also there as a witness to the child   
   abandonment.  Now that I know better, it is the Fire Department that is   
   to come rescue children from being home alone under prisonment with   
   Sheriff standby.   
      
   Coincedent to a second Sheriff Dept Case number 083020-129 Jeremy Gardea   
   did throw a 6 ft ladder over the common fence destroying approximately   
   $20,000.00 in property by vandalism.   This ladder toss was followed by   
   the delivery of hose water and rocks being thrown by Jeremy Gardea at my   
   property again directed at vandalism.   
      
   On another incident that was recorded on a 911 call Jeremy Gardea also   
   sledgehammered down a 10 ft of fence on our common property line.  Stacy   
   Gardea was imploring her husband to stop upon the direction of the 911   
   operator, but for not.  He kept at it until he was done.   
      
   On another incident there was a set up dog attack from hiding by laying   
   in wait on 18 Oct 08 with an Animal Control Complaint 08-011965 filed in   
   biting the Petitioner.  Some 6 months prior Animal Control did respond   
   to these very same dogs which did attack and eat alive a pet pig in the   
   Gardea’s back yard that was also to witnessed to by the Petitioner and   
   Animal Control Officers.  On the dog attack to Petitioner, Farmers   
   Insurance company on hire by the Respondent has already paid over   
   $1000.00 in medical and property damage that had enough witness and   
   irrefutable prima facia evidence to convince them to make some   
   compensation for damages.   
      
   Jeremy Gardea has threatened to physically attack me in prior occasion,   
   and yesterday on or about 2 pm of 13 April 2009, he did say to me “YOU   
   ARE GOING TO FIND GOD, YOU DOG”.  I understood this as a death threat,   
   and talked to Sonoma Sheriff Deputy Crap (sic) for an investigation and   
   according to the Sheriff Deputy that in talking to the Respondent what   
   Jeremy intended to say was for Bible recruitment as a Christian to   
   become like him.  He was sorry for the misunderstanding in having it   
   sound like a death threat but this statement was for the Petitioner in   
   finding Jesus according to Deputy Crap (sic).   
      
   Jeremy Gardea has illegally put my house and private life under   
   surveilance using video camara to photograph my private back yard living   
   situation that is behind a 6 ft fence with a 2 ft privacy screen for the   
   purpose of media exposure as he can not get any where with law   
   enforcement agencies he says.  I have the legal expecation of privacy   
   and the Gardea family will not leave me alone in my privacy by   
   constantly invading it as a pattern and practice of harassment.  I have   
   asked Jeremy Gardea to stop talking to me repeatedly and again, he will   
   not attend to this request.   
      
   This invasion of privacy includes wide media exposure on the front page   
   in the Press Democrat, where Jeremy Gardea stated that I “was a drug   
   dealer”.  Gardea stated for the Sonoma County Sheriff and the Permit   
   Resources Department to “go after me” and that Gardea said “I am not   
   afraid of  him”.   
      
   The Gardea’s use their minor children who live with them, and other   
   children (DOES 1 thru 50) who visit or live at 112 Hull Street to be   
   atop the 8 ft fence and spy upon my back yard in also constantly   
   invading my privacy.  Jeremy and Stacy Gardea control the people who are   
   on their property and they are likewise to be told by the Respondents to   
   guard their neighbors (Petitioner) privacy if you would be so kind.   
      
   CH-100, Item 12                 TEMPORARY ORDERS   
      
   Jeremy Gardea, Stacy Gardea and Minor Children DOES 1 thru 50 are to not   
   put my back yard under video or visual surveilence so as to not look   
   over the 8 ft fence violating the legal expectation of privacy for the   
   Petitioner.   
      
   Jeremy Gardea, Stacy Gardea and Minor Children DOES 1 thru 50 are not to   
   talk, address, communicate, write or speak to Petitoner.   
      
   Jeremy and Stacy Gardea are not to call the police, the fire department,   
   or any other government agency for frivilious and useless harassment   
   calls against the Petitioner thereby using these agencies as a tool of   
   harassment.  This is documented in the aforementioned CPS Terrorist   
   Threat.  It is recently exampled by a Fire Department response against   
   the Petitioner for using a propane torch to melt weeds in poison free   
   garden control, an action that the Fire Department said was okey to do.   
     Thus wasting valuable taxpayer resources and also my loss of wages.   
      
   Jeremy and Stacy Gardea are not to talk to the media, such as newspaper,   
   radio or television station programs concerning the Petitioner so as to
