I also don't believe your first name       is Christopher (I don't think you are brazen enough to use your real       1st name). The name Kidwell....I believe that one. That's not a name a       person would make up out of the blue.              Anyway, when you first started posting on this site, you stated you had       been having sex with your niece since she was 5 yrs. old. You BELIEVE       that is okay. You obviously don't want to refer to this act as rape       because you BELIEVE if it is consensual, it is okay. You need to change       your beliefs and if you really find it necessary to discuss it on this       board any further, please refer to the act by it's legal name, "RAPE".       Just because you want to violate children and not own up to the       responsibility for your actions, doesn't give you the right to call it       anything but what it is.              I have posted the Ohio Revised Code and Maryland Law concerning RAPE       for your reading entertainment. When you read the Rape Section for the       Ohio Revised Code, pay particular attention to Section: A(1)(b). Then       read the penalty. When you read the Rape Section for Maryland, pay       particular attention to 3-304(a)(3)(b). Again, read the penalty.              You have confessed to RAPE. You can not convince anyone else of       anything different. We don't care what YOU believe to be right or       wrong. We don't care that you don't want to admit to yourself that you       RAPED a child. We don't care that you want to keep claiming "consent"       makes a difference. It does not make a difference by law, as the child       does not have the ability to give consent.              Happy reading. Rape.              (A) (1) No person shall engage in sexual conduct with another who is       not the spouse of the offender or who is the spouse of the offender but       is living separate and apart from the offender, when any of the       following applies:              (a) For the purpose of preventing resistance, the offender       substantially impairs the other person's judgment or control by       administering any drug, intoxicant, or controlled substance to the       other person surreptitiously or by force, threat of force, or       deception.              (b) The other person is less than thirteen years of age, whether or not       the offender knows the age of the other person.              (c) The other person's ability to resist or consent is substantially       impaired because of a mental or physical condition or because of       advanced age, and the offender knows or has reasonable cause to believe       that the other person's ability to resist or consent is substantially       impaired because of a mental or physical condition or because of       advanced age.              (2) No person shall engage in sexual conduct with another when the       offender purposely compels the other person to submit by force or       threat of force.              (B) Whoever violates this section is guilty of rape, a felony of the       first degree. If the offender under division (A)(1)(a) of this section       substantially impairs the other person's judgment or control by       administering any controlled substance described in section 3719.41 of       the Revised Code to the other person surreptitiously or by force,       threat of force, or deception, the prison term imposed upon the       offender shall be one of the prison terms prescribed for a felony of       the first degree in section 2929.14 of the Revised Code that is not       less than five years. If the offender under division (A)(1)(b) of this       section purposely compels the victim to submit by force or threat of       force or if the victim under division (A)(1)(b) of this section is less       than ten years of age, whoever violates division (A)(1)(b) of this       section shall be imprisoned for life. If the offender under division (A)       (1)(b) of this section previously has been convicted of or pleaded       guilty to violating division (A)(1)(b) of this section or to violating       a law of another state or the United States that is substantially       similar to division (A)(1)(b) of this section or if the offender during       or immediately after the commission of the offense caused serious       physical harm to the victim, whoever violates division (A)(1)(b) of       this section shall be imprisoned for life or life without parole.              (C) A victim need not prove physical resistance to the offender in       prosecutions under this section.              (D) Evidence of specific instances of the victim's sexual activity,       opinion evidence of the victim's sexual activity, and reputation       evidence of the victim's sexual activity shall not be admitted under       this section unless it involves evidence of the origin of semen,       pregnancy, or disease, or the victim's past sexual activity with the       offender, and only to the extent that the court finds that the evidence       is material to a fact at issue in the case and that its inflammatory or       prejudicial nature does not outweigh its probative value.              Evidence of specific instances of the defendant's sexual activity,       opinion evidence of the defendant's sexual activity, and reputation       evidence of the defendant's sexual activity shall not be admitted under       this section unless it involves evidence of the origin of semen,       pregnancy, or disease, the defendant's past sexual activity with the       victim, or is admissible against the defendant under section 2945.59 of       the Revised Code, and only to the extent that the court finds that the       evidence is material to a fact at issue in the case and that its       inflammatory or prejudicial nature does not outweigh its probative       value.                                          Maryland Code              § 3-304. Rape in the second degree.              (a) Prohibited.- A person may not engage in vaginal intercourse with       another:              (1) by force, or the threat of force, without the consent of the other;              (2) if the victim is a mentally defective individual, a mentally       incapacitated individual, or a physically helpless individual, and the       person performing the act knows or reasonably should know that the       victim is a mentally defective individual, a mentally incapacitated       individual, or a physically helpless individual; or              (3) if the victim is under the age of 14 years, and the person       performing the act is at least 4 years older than the victim.              (b) Penalty.- A person who violates this section is guilty of the       felony of rape in the second degree and on conviction is subject to       imprisonment not exceeding 20 years.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
