   No, actually if they entered the country improperly and weren't caught in   
   the act then they would all be guilty of a criminal violation.

   Any alien that enters improperly that isn't apprehended in the act, is   
   subject to a punishment that can include up to 6 months in jail. A criminal   
   offense IOW.   
      
   A repeat offense is a felony with a sentence of up to 2 years.   
      
   It is a civil offense only if they are caught in the act of trying to enter,   
   or they enter legally and then overstay their visa.   
      
   If they successfully enter improperly then by law, it is a criminal offense.
