   Your answer is incomplete, and thus misleading.   
      
   If they are here and entered improperly then USC 1325 makes that a crime   
   punishable by jail time.   
      
   So simply "being" here having entered improperly IS a criminal act.   
      
   I thought you said you read the statute? Apparently you didn't or you didn't
