   Actually, the conclusion that P2P is now legal because of this ruling is   
   questionable. CRIA simply failed to prove that the files were uploaded by   
   the 29 defendants.   
      
   Downloading may not be considered a copyright violation by the Copyright   
   Board but uploading may still be considered illegal. If CRIA can prove that   
   a specific song was uploaded at a specific time by a specific user on a   
   specific IP, then they could have a case against this user. This information   
   may be difficult to obtain but it's not imposible to obtain. For example,   
   any consultant compiling information on what material is available online   
   could provide specific information regarding what they've downloaded and   
   from whom.
