   I agree with the ruling myself, that one cannot assume that distribution   
   took place simply because it had been made available online. We can't assume   
   the defendants uploaded anything. And many of the P2P files have limited   
   accessibility because the users that make these files available have slow   
   connections and/or don't remain online for long periods.   
      
   I doubt CRIA's appeal will go far without specific evidence on the file   
   transfering activities of the defendants. Without this information, all they   
   can hope for is the court to clarify its limited jurisdiction, on uploads   
   beyond Canada's borders.   
      
   I think we'll eventually see the internet for what it is - Another   
   broadcasting medium from which performance royalties could be obtained (from   
   advertising and sales) to compensate artists for music that is being   
   previewed by the public.   
      
   P2P users could always sign contracts forcing these users to implement time,   
   copy and burn limitations on any uploads that weren't specifically cleared   
   for unlimited distribution. This limited distribution could also be   
   legislated and/or be controled by tougher acceptable user policies at our   
   IPs.
