   It may not be a lie, but it is an unsubstantiated statement.   
      
   In addition, the analogy is wrong. (Most analogies are.)   
      
   When people are opposing the death penalty they are saying that a person   
   has a right not to be killed by the state. They would probably agree   
   that a fetus shouldn't be killed by the state.   
      
   A person that is pro-choice is saying that the state doesn't have a   
   right to punish a woman for having an abortion. And, the state doesn't   
   have a right to punish a woman for getting pregnant. And, the state   
   doesn't have a right to punish a woman for giving birth to a child.
