   Yes. You cannot be deprived of your property without due process of criminal   
   law. Driving privilege is another matter entirely, and has nothing   
   whatsoever to do with ownership of the property.   
      
   Revocation of driving privilege for cause, like for reckless driving on   
   public roads, is pretty much in the democratic public interest, as it   
   definitely qualifies as infringements on another's rights to kill them while   
   recklessly driving.   
      
   But that in no way means they can take your car for said infraction. As   
   proof, I will point out that after the car is impounded as a result of any   
   accident in which one recklessly drove and hurt/killed someone or damaged   
   property, when the process is over and it is no longer needed for evidenced,   
   no matter the outcome, you will receive a bill for towing and storage of   
   your vehicle along with a demand that you come and get it.
