   A West St. Paul man has pleaded guilty to fatally shooting a man outside a   
   Minneapolis White Castle restaurant, and is set to be sentenced to 38 years in   
   prison.   
      
   Lionell Hicks, 32, accepted a plea deal offered by the office of Hennepin   
   County Attorney Mary Moriarty, which if accepted by a judge will see him   
   sentenced to 463 months in prison for 2nd-degree murder.   
      
   Hick fatally shot Tu'Quan L. Smith Sr., 32, outside the White Castle on Lake   
   Street in the early hours of Aug. 15, 2021, which followed what prosecutors   
   describe as a "brief, random encounter" at the drive-through.   
      
   An apparent disagreement unfolded between the occupants of three vehicles that   
   were using the drive-through, which culminated with Hicks leaning out of the   
   window of the vehicle he was in and firing several shots into a black Chevy   
   Malibu, killing Smith.   
      
   "This was a callous, destructive act that brought unimaginable pain to the   
   victim's family and my thoughts are with them today," said Moriarty.   
      
   "Prioritizing community safety is paramount. Communities are suffering because   
   there are too many guns in irresponsible hands that cause minor incidents to   
   turn violent – and deadly – far too often. When necessary, we will use   
   long prison sentences    
   to protect the community and incapacitate those who commit this violence."
