XPost: talk.politics.guns, milw.politics, alt.fan.rush-limbaugh       XPost: soc.women, sac.politics       From: noreply@mixmin.net              https://encrypted-tbn0.gstatic.com/images?q=tbn:ANd9GcTETVenjHbP       4GElnh3RcMP_0OOYn-KlH864g&s              A 21-year-old Kenosha man convicted of sexually assaulting a cognitively       disabled elderly woman will spend 30 years in prison.              Vonell Shaw was convicted in March of impersonating a police officer to gain       entry to the 66-year-old woman’s apartment, convincing her to give him the       PIN for her debit card, then sexually assaulting her before leaving with the       card and using it to        steal money from her bank account.              He was convicted of impersonating a police officer, burglary, third-degree       sexual assault, aggravated battery of an elderly person, theft,        isappropriating an ID to obtain money and bail jumping.              His sentencing was delayed because he allegedly threatened his defense       attorney after his conviction, leading the attorney to withdraw and a new       counsel to be appointed.              At his sentencing Wednesday, Shaw continued to argue that he was innocent of       most of the crimes for which he was convicted, saying he did use the woman’s       debit card, but denying he had gone to her apartment or sexually assaulted her.              “I am innocent besides the financial crimes. There was evidence to show my       innocence, and it wasn’t presented at trial,” Shaw told Judge David       Bastianelli.              Shaw argued his court-appointed defense attorney did not present evidence       showing that DNA found on a blanket in the woman’s apartment did not match       his. He also said the attorney didn’t offer his alibi.              “He sold me up,” Shaw said.              Bastianelli was not sympathetic.              “In this case, there was a great deal of evidence of what you did,” the       judge said. “The circumstantial evidence in this case was overwhelming, and       there was direct evidence” of the victim identifying Shaw.              Among the evidence was video of Shaw using the victim’s debit card and PIN       number at an ATM shortly after it was taken from her apartment.              Shaw testified at trial that he was a drug dealer and that someone — he said       he did not know the person’s name — gave him the debit card and PIN number       in payment for drugs.              He had also previously pleaded guilty to gaining entry to a different elderly       woman’s apartment by posing as a Carthage College student in need of help,       then of exposing himself to the woman. When the woman pushed him out of her       apartment he stood        outside the door and said, “Aren’t you lonely.”              Lengthy record       Bastianelli also recounted a lengthy criminal record, including burglary,       theft from a relative, robbery and a harassment case in which he called a       woman as many as 1,000 times from jail, once leaving her a threatening       voicemail.              “I do agree that a lengthy prison sentence is warranted to protect the       community,” Bastianelli said.              He sentenced Shaw to a total of 30 years of initial confinement in prison       followed by 16 years of extended supervision. Shaw is already serving a prison       term for a previous offense; that term ends next year.              Shaw’s statements in court indicated he is likely to appeal his conviction,       claiming he had ineffective assistance of counsel.              https://kenoshanews.com/news/local/man-sentenced-to-years-for-se       ual-assault-of-disabled-elderly/article_436230c2-9fab-566f-bf42-       3e669ecbf34.html              --- SoupGate-DOS v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
