              Tonight's news has revealed that there are 5 major court decisions pending       with regards the expansion of Kinder Morgan into Burnaby and tankers on the       west coast.              The most important one is the one filed by indigenous groups that claims that       the federal government failed in their "duty to consult" before the NEB gave       approval to the expansion.               How important is this? Well, there is already a precedent case that ruled in       favour of an indigenous challenge - and they won - and the pipeline was       cancelled.              And that decision is due anytime from the Federal Court of Appeal. And we       hope it has the same effect on Kinder Morgan as it did on the Northern Gateway       pipeline.       _______________________              See you in court, Kinder Morgan September 14, 2017              On October 2, 2017 – in just over two weeks – the Federal Court of Appeal       (FCA) is scheduled to start the longest hearing in its history, for the       consolidated challenges to the National Energy Board (NEB) and Federal Cabinet       approval of Kinder Morgan       s Trans Mountain Project. The current record-holder for longest FCA hearing       is Gitxaala vs. Canada, also known as the case that killed Enbridge Northern       Gateway. That case was heard almost exactly two years prior to the Kinder       Morgan hearings.              In a refreshing moment of (legally required) honesty, Kinder Morgan       acknowledged the risks associated with the FCA case and others when it stated       in its May 25, 2017 prospectus:               In the event that an applicant is successful at the Federal Court of       Appeal, among other things, the NEB recommendation or Governor in Council’s       approval may be quashed, permits may be revoked, the Trans Mountain Expansion       Project may be subject to        additional significant regulatory reviews, there may be significant changes to       the Trans Mountain Expansion Project plans, further obligations or       restrictions may be imposed or the Trans Mountain Expansion Project may be       stopped altogether. (at p.29,        emphasis added)       ________________________________              The duty to consult              When the Tsleil-Waututh Nation, Squamish Nation, Coldwater Indian Band, Upper       Nicola Band, Stk’emlupsemc Te Secwepemc and Sto:lo applicants appeared in       court last October, they argued that the government failed to properly consult       with their individual        nations before approving the expansion.              It is an argument that has proven deadly to past projects.              In 2016, the Federal Court of Appeal ruled that the government had failed to       properly consult First Nations affected by the Northern Gateway pipeline,       effectively shutting the door on that project.              When it comes to Kinder Morgan’s current project, Our Sacred Trust, a       Tsleil-Waututh Nation initiative aimed at stopping the expansion, says on its       website, “Extracting oil from the ground and transporting it to market via       pipelines is impossible        without consulting First Nations whose lands are affected.”              https://www.ecojustice.ca/indigenous-peoples-leading-charge-against-km/       _________________________              Good luck to them, to all British Columbians who put environment and health       over profit and wealth, and to our future as a beautiful province that depends       on a beautiful coastline.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
