|    TURMEL: Crown Brown escapes Voytek Krzyz    |

      From: johnturmel@yahoo.com              JCT: It was a great day for Voytek Krzyz and a pretty good       day for Crown Andrew Brown at his Quash Motion in St Johns       Court in Newfoundland yesterday morning.              When I met Voytek, he was ready to go to court in the usual       casual clothes but I insisted he go get himself a suit and       show a little respect for the court. He did. So both the       Crown and judge had an easier time being courteous than       normal. It always pays off to show respect with good suit!              Crown Brown has delayed the original Quash motion with an       erroneous claim that there had to be a Notice of       Constitutional Question filed first. There was no       constitutional issue and I refused to let Voytek file one. I       was going to put Crown Brown on the spot against the Rogin       decision where the Crown agreed there was no constitutional       question.              The police served a notice on Voytek to go and have his Bail       Order amended to include the condition not to use the cell       phone that was accidentally omitted in the Bail Order. It       had been stuck off on its own page, condition 10, and may       have just been missed.              And Brown served a large Motion Record in Response to the       Quash too.              So the hearing started with Voytek asking for leave to amend       his Motion for Return of Controlled Substance to wherever he       happened to be legal. He didn't want to refile a new one       after the required 60 days to claim. But the Crown       consented.              As for the Crown objection to the hearing without Notice of       Constitutional Question, Crown Brown said he had       reconsidered and was prepared to argue against the Quash       Motion. So he deftly ducked out of the Rogin predicament.       Nothing smarter than admitting an error and moving on.              So all Voytek could do was ask for some time to prepare his       Reply which was granted. July 15 for hearing!              So Voytek had a great day and Andrew Brown had a great day       considering how he could have been bloodied had he put up a       fight on the lost causes.              So now everything is back to normal. Voytek is walking on       air after his courteous treatment by both the Judge and the       Crown. Remember, he once got his 6 pounds of pot back from       an Alberta bust, so, for him, it's not precedent!              Sad I won't be able twit "Keystone Krown" or "Newfie Crown"       Andrew Brown any more. I give the kid credit for digging       himself out of some pretty big holes.              But now I get to parse his response so it's back to       respectful but thorough beatings that his losing arguments       will merit.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
