      From: johnturmel@yahoo.com              JCT: Maxime Gauthier, Martin Gendron, Eric Gravel are now       joined by Danny Deziel in a "Smith BENO" Quash motion before       the Quebec Provincial Court in Montreal on Thursday Aug 20       2015. Again, the Crown was unprepared to deal with it and it       got put off the Sep 23 2015.              I really don't mind because that gives them another month to       add more people to the move. Anyone before the courts can       file to be heard with them on the same day, making it quite       an event that won't be that easy to stall any more.              Plus, we have the Ontario Big Event by James Turner in       Ontario Superior Court with jurisdiction to declare the laws       invalid absent the valid exemption like a provincial court       judge may not. He just stays the charge stating it's       unconstitutional and when a Superior court judge backs it up       on appeal, then it's official in that province.              James already had his first Quash Motion dismissed long ago       by Superior Court Justice Ray. Now he's back in Superior       Court asking with new card: Smith. Wonder if they're going       to now argue Ray was wrong and James should have been and       should be in provincial court.              Regardless, if this Superior Court judge can fix a typo on a       defective indictment pursuant to S.601, he can fix it by       quashing when there's a bad charge on it too.              And the more people riding on the issue by the Aug 31 makes       quite the interested contingent coming to watch from       Montreal.              I'm just amazed so few people reading this are passing it       along to current victims.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
