      From: johnturmel@yahoo.com              TURMEL: 13 Smith BENO Quash Appeals in Toronto Tuesday              JCT: We've been waiting a long time for our 15-minute       motion. It got put off to include information I didn't think       relevant and had asked to dispense with. Then it got put off       again for no particular reason.              The Crown served their Motion Record in Response except it       didn't have any response. No factum, nothing! Har har har.       I've never seen a Motion Record in Response without any       response!              Imagine, a motion we can present in 15 minutes has the Crown       completely baffled. No response but stall in 4 Quebec BENO       Quashes, same with the 3 Ontario BENO Quashes.              I'm going to let the judge know that I'm going to to the       Toronto Courthouse and seek out every marijuana charge and       get them to file a Smith BENO Quash. Get a lot of Crowns       dancing for adjournments.              The last time the courts declared the first Parker-Hitzig       BENO period, the Crown dropped the last 4,000 active charges       but didn't expunge the records of the 100,000 bogus       conviction during the period.              So if they only have to drop remaining charges, and they got       away with not expunging previous bogus convictions, why       shouldn't they stall for as long as possible and get as many       bogus convictions they won't erase as possible?              So going into the duel against an unarmed Crown. Better       bring his tap-dancing shoes.              If the judge gets how Parker-Smith works like Parker-Hitzig,       I ask him to stay all marijuana prosecutions below and empty       the jails of all those convicted of marijuana offences       pending our appeal.
