      From: johnturmel@yahoo.com              JCT: In my last post titled "TURMEL: Smith BENO Quash in       Gatineau (Chevalier?) Dec 16!" I mentioned that not only had       Judge Chevalier fine a 30-plant medical grower $1.25 but he       had been the first judge in Canada to follow the Hitzig 170       precedent that if you can't get an exemption, all you have       to do is prove that you had medical need. And that's what       Johnny Dupuis did, bring his doctor to court who testified       about how his application for Johnny's exemption had been       rejected by the examining pharmacists at Health Canada but       that he approved of Johnny's use no matter the opinion of       the ruling pharmacists. And Judge Chevalier agreed.              I would also now point out that Chevalier was the judge who       fined Ray Turmel $125 for his gaming house in Gatineau in       the mid 1990s!! Har har har. He and the Turmels go back a       long way.              I also mentioned:        Now, the most fascinating coincidence is we have a Smith        BENO Quash motion coming up in Gatineau Provincial Court        on Dec 16 2015!!! What a coincidence? In the very same        courthouse where Chevalier stayed Dupuis charge and        fined the grower $1 for 30 plants, we have the hope he's        the judge for our 1st Smith BENO Quash in Quebec.        What an incredible break. The judge who used his own        understanding of Parker to stay Dupuis' charges like        Parker's were stayed. And it didn't make the news.        So let's pray for serendipity in our judge.        Should be a great time regardless.        Dec 16 9:30 Courtroom #12.              JCT: Now the final coincidence!! They have a program called       "diversion" where they get the accused to contribute to       charity or do community service to avoid a criminal record.       But not for this drug kingpin! Guess who they're trying to       saddle with a criminal record under S.4 Possession for 3       grams and S.7 Cultivation for 3 clones?              My niece: Marie Eve Turmel!!! She was pulled over and busted       by the local Barneys for such trivial numbers.              After making Ray's 3 Provincial Court Motions, 3 Superior       court motions, 3 appeals and 1 application for leave to the       Supreme Court of Canada, the Crown gave up on his 500-plant       over-grow mandatory minimum charge. And now in the waning       months of prohibition, they've picked a fight with a Turmel?       They're going to get it. She filed a Smith BENO Quash       motion.              At the first hearing, the Crown had tried to get it put off       to the trial judge but a useful lawyer in the room Andre St-       Onge spoke up and pointed out how it had to be dealt with       before plea and so could not be reserved to the trial judge.       Wow!!! So the judge slated an hour for the hearing of the       Smith BENO Quash motion before plea in Gatineau on Wednesday       Dec 16 9:30am Courtroom #17. Officially, no ducking now.              We know that all those who've been stalled like James Turner       and the Montreal MedPot Musketeers can point at Marie Eve       and ask why she didn't have to wait for her trial judge, she       didn't have to file a Notice of Constitutional Question.       What? do the Turmels get special treatment?              But if they think they're going to add my niece to their       trophy wall on the even of repeal, saddle her with a       criminal record under invalid sections, do have a surprise       coming. But what an incredible coincidence, eh?              We're going to be doing a pro-cannabis demo in front of the       Gatineau Courthouse 9am and then go in for 9:30am. Parking       lot just behind so it'll be easy to stash our signs. You can       bet Ray will be there flashing his 150gm baggie of pot at       autos-and passers-by.              Pop on over to the Gatineau Courthouse to see the show.       Marie Eve's got the Turmel fast-talking gift-of-the-gab.       With the judge having to watch that she gets treated right       (without a lawyer that's the judge's job, not to defend but       to not allow screwing), the Crown is going to rue the       decision not to divert her out of the courts.              And of course, even if they try to bribe her with a       diversion now, it's too late now! We're in for a hearing.       Marie Eve knows what's at stake for everyone in Canada with       a criminal record or facing charges if she wins. Plus she       can take the deal after anyway. Do you think they'll take it       back? Har har har har har har. She'll be ready.
