   JCT: Dec 16 2015, we had our first withdrawal of charges by   
   the Crown to avoid the Smith BENO Quash motion.   
      
   Here are the Le Droit and TVA reports on my niece: Marie Eve   
   Turmel hearing in Gatineau Court of Quebec facing charges   
   after being busted with 3 grams and 3 clones where an hour   
   was slated for the hearing of her Smith BENO Quash motion.

   Sortie remarquee d'un juge sur le cannabis: plainte a la   
   magistrature   
   JCT: This was a story about someone who filed a complaint   
   against the notable retirement of Judge Chevalier's $1 fine   
   for a 30-plant medical grower. Same day as our case.

   Des odeurs ont envahi le palais de justice   
   de Gatineau mercredi.   
   "Psychedelic odors invade the Gatineau Palace of Justice   
   Wednesday"   
      
   Devant l'edifice Jos-Montferrand, une dizaine de personnes   
   ont manifeste pour la legalisation du cannabis. Dans le lot,   
   un militant bien connu, Raymond Turmel, espere que sa fille   
   sera acquittee de possession et de production de marijuana   
   en s'appuyant sur de recentes decisions de la cour.   
   "In front of the Jos-Montferrand building, a dozen people   
   demonstrated for the legalisation of marijuana. In the   
   group, militant Raymond Turmel hopes his daughter will be   
   acquitted of Possession and Production of marijuana by   
   relying on recent decisions of the court."   
      
   Raymond Turmel s'est fait connaitre au debut des annees 2000   
   en devenant l'un des premiers a obtenir un permis de   
   consommation de cannabis a des fins therapeutiques.   
   "Raymond Turmel got known at the start of the 2000s by   
   becoming one of the first to obtain a permit for use of   
   marijuana for medical purposes."   
      
   JCT: Actually, he was known for being busted for growing it   
   for his ailing wife. It took him 10 years to get an   
   exemption. And he was later busted for over-growing 500   
   plants in which the Crown got ground down by 10 different   
   motions all the way to the Supreme Court and gave up. And   
   they think busting his kid is going to be easier?   
      
   Sa fille Marie-Eve a ete arretee cet ete avec trois grammes   
   de marijuana et trois boutures de la plante. Cette derniere   
   n'a pas de permis pour posseder du cannabis, contrairement a   
   son pere.   
   "His daughter Marie-eve was arrested with 3 grams of   
   marijuana and 3 clones. She did not have a permit to   
   possess, unlike her father."   
      
   Pancarte a la main, le personnage colore avait au bout de   
   son collier un impressionnant sac rempli de cocottes de   
   cannabis.   
   "Placard in hand, the colorful character had around his neck   
   a tie made up of an impressive baggie will with cannabis   
   buds."   
      
   Avant la comparution de sa fille, le militant profitait de   
   l'ouverture des portes par les passants pour souffler sa   
   fumee a l'interieur du palais de justice.   
   "Before his daughter's appearance, the activist profited by   
   the opening of the courthouse doors by those entering to   
   blow smoke into the Palace of Justice."   
      
      
   "I just stood there and waited for the door to open," said   
   Raymond Turmel. There a vacuum, and others get to smell it

   everyone knows I was here with my baggie."   
      
   M. Turmel se dit inspire par les recentes declarations du   
   juge de la Cour du Quebec, Pierre Chevalier, qui a qualifie   
   les lois sur le cannabis de . Cette   
   declaration, faite au palais de justice de Gatineau dans un   
   dossier de production de trente plants, a d'ailleurs cause   
   une commotion dans le milieu judiciaire. L'accuse d'alors a   
   recu une amende de 1$.   
   "Mr. Turmel is inspired by recent declarations of Court of   
   Quebec Judge Pierre Chevalier, who qualified the laws on   
   cannabis as "antiquated and ridiculous." This declaration,   
   made at the Gatineau Palace of Justice in the case of   
   production of 30 plants, also caused a commotion in judicial   
   circles. The accused was fined $1."   
      
      
   ""The law is dead according to Judge Chevalier," said   
   Raymond Turmel. Even if the Crown goes on appeal, we'll be   
   there to defend."   
      
   Mercredi, la juge Anouk Desaulniers a entendu une partie des   
   arguments de la fille de M. Turmel. La magistrate lui a   
   propose de remettre a une date ulterieure, etant donne la   
   complexite de sa demande. Le clan Turmel veut faire declarer   
   inconstitutionnelles certaines dispositions de la loi sur le   
   cannabis. Le pere est entre dans le palais de justice avec   
   son sac rempli de cocottes vertes. L'odeur etait facilement   
   perceptible dans la salle de cour.   
   "Wednesday, Judge Anouk Desaulniers heard part of the   
   arguments of Mr. Turmel's daughter. The magistrate proposed   
   putting it off given the complexity of the motion. The   
   Turmel clan wants to declare certain sections of the law on   
   cannabis unconstitutional. The father entered the Courthouse   
   with his bag full of green buds. The odor was easily   
   perceptible in the courtroom."

   La juge Desaulniers a finalement annonce qu'elle se   
   recusait.    
   "Judge Desaulniers finally announced that she was recusing   
   herself. "To be transparent, I would indicate, and your   
   father will remember, that I was the Crown Attorney in the   
   case where he was accused. I'm going to recuse myself.""   
      
   Mme Turmel a dit comprendre, et a aussitot demande a faire   
   ses representations devant le juge Pierre Chevalier. Ses   
   propos ont provoque un eclat de rire generalise chez les   
   procureurs de la Couronne et les avocats de la defense   
   presents.   
   "Ms. Turmel said she understood and immediately asked if she   
   could make her motion to Judge Chevalier. That proposal   
   provoked a general burst of laughter among the Crown   
   Attorneys and Defence lawyers there."
