|    TURMEL: MMPR gone! submit old MMAR Amend    |
|    21 Mar 16 08:28:12    |
From: johnturmel@yahoo.com              JCT: I've been thinking. Under the MMAR, patients had the       right to move, change dosages and growing data. Then under       the MMPR, that right became unnecessary with supply from       L.P.s (they argued).              Manson's Injunction was against a now-invalid MMPR to extend       the privileges of MMAR to those he let live. But without a       way to register changes with the MMAR database down, he       didn't order one so anyone who changed anything got knocked       out (to protect the viability of the MMPR, Manson said).              Now, with the MMPR struck down by Phelan, and the MMPR's       repeal of the MMAR not having taken effect, then the right       to amend should still exist again and the Crown has been       derelict in not re-opening the database to provide such       avenue of relief.              So if I had an ATP exemption and had to move or change       something I used to have a right to do under the MMAR, and       now with no MMPR to repeal the MMAR, it's kind of back-alive       except Health Canada hasn't done its duty to provide access       and supply through amendments in the same way they had       provided it in the past!              It's not our fault HC hasn't immediately set up the database       for editing again. I think I'll still just send them an old       MMAR application with the necessary changes so I can tell       any cops my application was sent in and Health Canada's       slow.              And if they won't accept that an Absent Exemption means No       Prohibition, then it's proving Parker in a constitutional       challenge we're already prepared to file.              Does anyone have an old blank MMAR Amendment form they can       upload for everyone to use?              I just can't think of any better way to add pressure on HC       and cover your asses to amend right now than sending in       the proper form that was never repealed by the invalid MMPR.       Can you? It sure beats sitting there waiting, doesn't it?              Especially if the Crown appeals, then it'll take years more       waiting without any new regime for self-growing or changes.       Get it? We can file old MMARs while the Crown wastes time       appealing and it puts them on the spot.              What a wonderful conundrum they face. What are they going to       do with proper documentation again in these times of       waiting? Paper in hand is always a pain for them to deal       with. They can't call the cops and say you've applied to       move. So rather than just move and hide, just move and apply       to someone who can't tell the cops anyway. Get it? Do what       you used to be able to legally do and submit the form to the       guys you used to legally submit them to who can't tell the       cops anyway.              Though I tell people who call me to "Do what you gotta do for       PMU" and be ready to put up a fight with my self-defence       protection, this is FREE extra coverage.              It's a neat way to push the Allard win in their faces while       they think they can stall the eventual loss on appeal. Are       they going to send you a letter saying they will not process       their own form now that the new ones have been struck down       (they're going to say: In 6 months and after we appeal, way       later than that)?              So we are not submitting the MMPR forms Justice Phelan said       were unconstitutional but the MMAR ones that used to be. Har       har har har har har har har har.              Submit the old MMAR form! Har har har har har har. And they       shouldn't tell.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
