|    TURMEL: David Butler's Allard BENO Quash    |

From: johnturmel@yahoo.com              Provincial Court Justice Burrill presiding.              FRI 12:07PM       Jct: So David, tell me about your adventure. Are they       starting to get worried or try to make fun of you?              No John. I actually think they're taking me serious. The       crown will send me their stand and I have to respond              Chris backer motored down and went thru the day with me.              New crown attorney yesterday and he was not prepared for me,       so after two delays he finally said there were several of       these quashes before the courts and asked to respond by mail       and I will have to stare up so smarts to make sure it's       right next court June 9              JCT: Don't worry, we have email. His only argument is: This       play has lost before (with other cards, always left out)              FRI 6:37PM       Jct: Plenty of time. So The Crown has to respond by Jun 9 or       that's your next hearing?              He will respond to the quash motion via mail then I have       respond to his response via mail before the June 9 hearing       if it's a constitutional motion it will be heard in another       court              Jct: It's not constitutional. That's explained right in the       motion. It's being considered by judges in 3 other provinces       without a Notice of Constitutional Question. And not by the       Trial judge either which kind of proves it's not the       bailiwick of the Trial Judge. So he has to respond before       the hearing. Great. I'll report the story. Nice of Chris to       drive over to support you.              Yes support is always nice. It was mentioned that it was       being heard in other courts. Even though the judge is a       local guy from the town, as I am, this is an unheard of       case, for someone to be standing up for their rights! So       what I know of this man is that the argument has to be right       and presented properly. An may the best team win!              Jct: And it's free.              JCT: So we'll have the Crown's response to Allard BENO but       the point is it is now officially in before fourth judge.       And officially in before a Judge of the Federal Court       yesterday.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
