      From: johnturmel@yahoo.com              JCT: Last Friday, I filed my motion for Repeal of       prohibition by striking "marijuana" from Schedule II of the       CDSA. But because the computer did not register that the       stay had expired on March 29, it was sent up for a       Direction.              On Monday April 11, Justice Phelan Directed that my Motion       for Summary Judgment could be filed if I also filed a Motion       to lift the expired stay.              So on Friday April 15 2016, I filed my motions to lift the       stay and for Summary Judgment for Repeal:               File No: T-488-14               FEDERAL COURT OF APPEAL       BETWEEN:        JOHN C. TURMEL        Plaintiff        and        HER MAJESTY THE QUEEN        Respondent               NOTICE OF MOTION TO LIFT EXPIRED STAY              TAKE NOTICE THAT Plaintiff moves for an Order lifting the       stay on the grounds it expired when the Crown did not appeal       by the April 29 2016 30-day deadline.              AND FOR ANY ORDER abridging any time for service or amending       any error or omission which this Honourable Court may allow.              Dated at Toronto on April 15 2016       John C. On Feb 26 2014, actions by over 300 "Turmel Kit"       Plaintiffs were stayed pending the resolution of Allard.              2. On April 8 2016, after the stay had expired on April 29,       Plaintiff attempted to file a motion for Summary Judgment       that was sent for Direction.              3. On April 11, the Court granted leave to file the Motion       for Summary Judgment with a motion to lift the stay.              4. Turmel              JCT: Anyway, it was $300 to file for the Summary Judgment       but for a shot at Repeal of Prohibition, cheap.              So now, just waiting for a date.              Of course, all the while, the Crown is beavering on their       motion to dismiss our actions because Allard took care of       all our issue!
