This is my letter in response to the Defendant's April 26       2016 request by letter.              2. On Monday May 2, 2016, Justice Phelan handed down his       ruling on the Crown's Request I had yet to received.              3. On Monday May 2 2016, I received the Crown's Letter of       Request asking the Court to refuse to file or to stay the       Motion for Default Judgment. Though the letter was dated       Tuesday April 26, it was not posted until Thursday April 28       afternoon, thus ensuring it would not arrive until Monday       next week May 2.              5. Given the expedition of the Court in granting Canada's       request, I had no opportunity to respond to the Request I       had not yet received.              5. Rule 208 says it takes a:        Motion to object        208 A party who has been served with a statement of        claim and who brings a motion to object to        (a) any irregularity in the commencement of the action,        (b) the service of the statement of claim,        (c) the Court as not being a convenient forum, or        (d) the jurisdiction of the Court, does not thereby        attorn to the jurisdiction of the Court.              6. Rule 208 says objecting to irregularities in the action,       or the Court not being a convenient forum or having       jurisdiction, has to be done by way of motion.              7. Canada has not made any motion objecting to my Motion for       Summary Judgment and a letter to the Clerk objecting to the       Motion for Default Judgment does not follow the Rules. Why       does the Crown get to send letters to the Administrator       which is not the proper way to object? Should Her Majesty       not also comply with the rules?              8. CR: Canada has therefore clearly indicated an intention       to defend this proceeding should the need arise. The motion       for default judgment is inappropriate in these       circumstances.              9. The need arose to defend within 30 days when the       Statement of Claim was served. Intention to defend is shown       by filing a Statement of Defence or a Motion to Object, not       missing the 30-day deadline then relying on improperly-       founded backroom requests to the Registry. No Notice, no       affidavits, no factum, Her Majesty breaking the Rules.              10. On May 2 2016, Justice Phelan ruled:               ORDER               UPON MOTION by the Plaintiff for default judgment;        AND UPON the Defendant having brought a motion to strike        the Plaintiff's claim (along with a number of similar        claims by other plaintiffs);        AND UPON the Plaintiff not having obtained leave of the        Court to bring a motion for default judgment against the        Crown, as required by s 25 of the Crown Liability and        Proceedings Act;        THIS COURT ORDERS that this motion is stayed until the        disposition of the Defendant's motion to strike without        costs.        "Michael L. Now that any Motion for Default Judgment has been       stayed, I request a date to proceed with my 20-minute Motion       for Summary Judgment.                            __________________________       John C. Until       my Motion for Summary Judgment is officially amended to       Default Judgment, nothing has changed. Pure bluff and I'm       calling.
