|    TURMEL: Marie-Eve Turmel files NO Consti    |

From: johnturmel@yahoo.com              TURMEL: Marie-Eve Turmel files NO Constitutional Question              JCT: My niece Marie-Eve Turmel was busted with 3 grams and 3       clones a while back and filed her motion to S.601 Quash       motion. That was put off to July 22 2016 by Judge Anouk       Desaulniers who deemed it was a Constitutional Question       needing a Notice of Constitutional Question to all of Canada       Attorneys General. Okay. Done. Served by fax on all of them.              CANADA       PROVINCE OF QUEBEC       DISTRICT OF GATINEAU COURT OF QUEBEC       NO: 550-01-087798-155 (Criminal Chamber)               Between        Marie-Eve Turmel        Applicant               -and-               Attorney General for Quebec        Respondent               NOTICE OF ""NO"" CONSTITUTIONAL QUESTION              TAKE NOTICE that at 9:30a on July 22 2016 will be heard a       Motion to Quash pursuant to S.601 of the Criminal Code at       the Gatineau Courthouse which will raise no constitutional       questions.              From the second paragraph of the Quash motion: Ontario       Superior Court Justice Rogin in R. v. J.P. (2003) noted that       for the S.601 Quash Motion before him:        "[5] The Crown complains that notwithstanding that        J.P.'s Original application was not a Canadian Charter        of Rights application... the factum specifically states        that J.P. did not challenge the constitutionality of the        regulations which Phillips J. found not to contain an        offence."              But Judge Anouk Desaulniers has ordered that a Notice of       Constitutional Question be served on all provincial       Attorneys General. Though Parker and Hitzig raised       constitutional questions needing constitutional notice,       J.P.'s S.601 motion to quash did not. Though Parker and       Smith raised constitutional issues needing notice, my S.601       motion does not.              I hereby serve you notice that no constitutional questions       will be raised at the hearing.              Dated at Gatineau Quebec on May 19 2016.              _____________________________       Applicant/Accused Signature       Marie-Eve Turmel              FAXED TO:       Attorney General of Canada 613-990-7255       Attorney General of Alberta 780-422-6621       Attorney General of British Columbia 250-356-9154       Attorney General of Manitoba 204-945-2517       Attorney General of New Brunswick 506-453-3651       Attorney General of Newfoundland 709-729-2129       Attorney General of Northwest Territories 867-873-0307       Attorney General of Nova Scotia 902-424-1730       Attorney General of Nunavut 867 975-6349       Attorney General of Ontario 416-326-4007       Attorney General of Prince Edward Island 902-368-4910       Attorney General of Quebec 418-646-0027       Attorney General of Saskatchewan 306-787-1232       Attorney General of Yukon 867-393-6379              JCT: Aaaaahhhh. I've been wanting to do that to a judge for       a long time. And it couldn't look better than on Judge Anouk       Desaulniers.              She was the Crown Attorney who put Ray in jail a decade ago.       Must have forgotten the tough time it was. Must have seen       "Turmel" on the indictment and thought it would be easy.              She hadn't even bothered to read it. Hadn't noticed how it       was explained that other judges didn't need Constitutional       Notice to hear the Quash. She just made a hasty judgment and       now gets to be joked about in the offices of 14 Attorneys       General. If there had to be a first, nice it was her.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
