|    TURMEL: Can Phelan dismiss when he imped    |

From: johnturmel@yahoo.com              TURMEL: Can Phelan dismiss when he impeded service?              JCT: I hope I left Phelan with a real problem. He had given       the Crown 20 days to file and 30 days for us to respond.              He granted the Crown use of email to save them running       around with 300-times duplicated Motion Records to serve and       file with the Registry, saved the Registry time and space       too, but when he was asked if Plaintiffs could also respond       by email to save patients having to run around, he just let       your clock run out with no answer forcing everyone to       physically run around by last Tuesday as he let the Crown       avoid doing.              If he had said we could respond by email too, I could have       then uploaded a kit which everyone could have served and       filed with ease. But no, Phelan wanted you running around,       paying printing costs the Crown got to avoid and missing the       deadline so he now has power to do you the dirty deed.              But I ran around. I got the objections to the Crown's motion       before Phelan. He's going to have to pretend he doesn't know       why the Crown's arguments are false and misleading from       everyone but me.              But his helping the Crown service and impeding your service       to then nix the damages claims of over 300 patients should       reek to high heaven.              If someone thinks they don't mind running around to also       file, send it in. It's got the Magic Words asking for       extension of time.              Interesting tidbit about the filing the other day in Federal       Court. They couldn't find any record of the Crown serving       us. I helped her find the judgment giving them 20 days and       us 30 days and assured her that I was on time.              So what to do? She didn't know when they served it, whether       I was late or not.              I solved her problem. I showed her the Open Sesame words       asking for an extension of time in advance when necessary.       She beamed and said that as long as the request was in       writing, it's okay. She stamped the Response received even       though there's no record the Crown served their motion on me       yet.              Love those Ali Baba words.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
