HMTQ Court file No. 36941              JCT: So those are the 9 of the 26 Federal Court of Appeal       Appellants who've asked for Leave to Appeal Phelan playing       doctor on their files. All classes covered. Ray for ATP       against MMAR conditions, several Left-Outs, several Never-       Ins but Should-have-been-Ins, and healthy me wanting its       benefits.              CR: Further to Canada's previously filed responses to the       applications for leave to appeal in the above-noted matters,       I am writing to provide clarification concerning the costs       portion of the Federal Court of Appeal decision below.              In its responses to the leave applications, Canada noted       that the applicants' appeals to the Federal Court of Appeal       were dismissed "with costs." In fact, only the appeal of the       lead appellant in the Federal Court of Appeal and applicant       herein, John C. Turmel, was dismissed with costs. The       appeals of the remaining appellants were dismissed without       costs in accordance with an undertaking by Mr. Turmel to       bear the costs of all appellants in the consolidated       appeals.              Yours truly,       Jon Bricker       Counsel Business and Regulatory Law Division              JCT: Ah, they had to correct an error. A little one. Wish       they'd do better with their big ones.              Finally, applicants do not have to file a Reply. And since       I've filed a Reply to counter their arguments, the other 8       applicants may rest easy, your end of it is done. It's       getting to 3 of Canada's top judges.
