Unfortunately, that's when       his appeal period ran out. Then the Crown ignored the Court       Order and kept his equipment. But this hick Crown decided he didn't       want to sign forcing Robert to go to a commissioner of oaths       to swear an affidavit of service. According to the Agreed Statement of Facts, I was raided       and charged in ?????? with after complaining to the Police about       Health Canada's tardy renewal of my MMAR medical exemption       which I received 3 weeks later.              I, Robert Neron, residing at 27 Cimon St. in Moonbeam Ontario       make oath as follows.              1. According to the appended Agreed Statement of Facts, I was       raided and charged in March 2011, after complaining to the       Police about Health Canada's tardy renewal of my MMAR medical       exemption which I received 3 weeks later.              2. Upon sentencing, the Court ordered the return of my all my       medical equipment and the usual prohibitions on firearms and       $600.00 in victim surcharge and to remain in Canada till       October 24th, 2016.              3. I was resigned to accepting my conviction to get my growing       equipment back and could not appeal within the required 30-       days as I was waiting for my medical equipment. But when the       30 days elapsed, my medical equipment was not returned.              4. The reason I missed the 30-day deadline was the belief I       would be getting my medical equipment back in 30 days. Offences of which accused convicted:       Production of cannabis, two counts of possession of cannabis       resin, and possession for the purpose of trafficking.       4. Sentence imposed: 5.5 month conditional discharge; pay a       $600 victim fine surcharge and prohibittion from owning any       restricted weapons for the next 10 years. Date of sentence: May 10 2016              The appellant appeals upon grounds involving a question of law       alone not against conviction but against sentence and       dismissal of Appellant's S.601 Motion to Quash.              THE GROUNDS OF THE APPLICATION ARE just as the Hitzig "Bad       Exemption" [2003] by regulated Mis-Supply meant there was "No       Offence" in force since Aug 1 2001 absent an acceptable       medical exemption when J.P. was charged; so too, the Smith       Worse "Bad Exemption" [2015] by regulated Mis-Use means there       was "No Offence" in force since Aug 1 2001 absent an       acceptable medical exemption when the Accused herein was       charged. Applicant's cultivation charge should be quashed       while the Smith decision found the medical exemption required       by the Alberta Court of Appeal in R. v. Krieger was unworkable       between 2001 and 2015.
