      From: johnturmel@yahoo.com              TURMEL: Rene Ouellet files to remove trial from Judge Roy              JCT: You'll remember that Judge Morand had slated a hearing       for the Quash Motion so it's adjudication could orient his       case. Whether the elect to be tried by judge and jury in       Superior Court. But when Rene arrived, Judge Johanne Roy told       him she was starting his trial in lower court. And she did.              If she thinks she's going to screw him out of his election,       think again Madame. That's what certiorari is for, removing       cases to the higher authority. Rene just filed this in Quebec       City this morning for hearing on Wednesday Oct 19 2016. With       his expected continued trial on Monday Oct 25. We'll see.              CANADA       PROVINCE OF QUEBEC SUPERIOR COURT OF QUEBEC       DISTRICT OF QUEBEC (Criminal Chamber)       LOCALITE: QUEBEC       NO: 200-01-180625-141 Between        Applicant        Rene Ouellet        -and-        Attorney General for Quebec        Respondent               APPLICATION FOR CERTIOARARI              TO ONE OF THE HONOURABLE JUDGES OF THE SUPERIOR COURT OF       QUEBEC (CRIMINAL CHAMBER) SITTING IN AND FOR THE DISTRICT       OF QUEBEC, the Applicant states as follows:              THE APPLICATION IS FOR AN ORDER OF CERTIORARI ordering the       removal of the Accused's file from the Provincial Court to the       Superior Court for trial by judge and jury.              AND FOR ANY ORDER abridging any time for service or amending       any error or omission as to form, color, font, margins,       content which the Honourable Justice may allow.              THE GROUNDS OF THE APPLICATION ARE that the Accused was always       going to elect to be tried by judge and jury.              OVERVIEW              1. The Accused was charged with production of marijuana       contrary to S.7(1) of the CDSA.              2. Accused filed a pre-plea Motion to Quash under S.601 to be       dealt with by the judge of first instance.              3. On Feb 19 2016 Judge Johanne Roy ruled that the S.601       motion was constitutional and had to be heard by the Trial       Judge though no statute is being challenged under the Charter       and sent the Accused to Preliminary Inquiry.              4. On April 20 2016 at the Preliminary Inquiry, Judge       Christian Boulet also refused to adjudicate the Quash motion       and ruled sufficient evidence and demanded the election of the       accused. When Accused refused to elect until the validity of       the indictment had been ruled upon, the judge ordered the       clerk enter an election of "trial by Superior Court judge an       jury."              5. On May 9 2016, Superior Court Justice Rene de la       Sablonniere of first instance refused to deal with the Quash       motion that should have been settled below and sent the file       back to Provincial Court for adjudication. Not adjudication of       the trial but of the Quash Motion.              6. On July 29 2016, Judge Alain Morand ascertained that there       was no constitutional issue and that the the S.601 Motion to       Quash should be adjudicated before the Accused "orients his       plea." Due to time constraints, the motion to Quash was       adjourned for the first possible hearing to Sep 2 2016.              7. On Sep 2 2016, Judge Johanne Roy was under the impression       that she was hearing the trial and was completely unaware of       the motion to Quash.??? Without election or plea, she started       the trial and dismissed the motion to Quash.              8. With the indictment now ruled valid in her court, the       Accused could then orient defence and now wanted to be       returned to the jurisdiction of the Superior Court for plea       pursuant to the previous election for judge and jury entered       by Judge Boulet.              9.
