      From: johnturmel@yahoo.com              JCT: Robert Neron got a great deal to plead to possession       including the return of his equipment and wasn't planning to       appeal. But when the Crown ignored Justice Riopelle's Order to       return the pot, Robert filed an application for extension of       time to appeal.              Court of Appeal Justice Hourigan pointed out that an Appellant       had to have intent to appeal within 30 days and the Crown not       complying within 30 days isn't relevant. There are other       recourses for that. He could appeal to 3 judges but they'll       just agree. And to the Supreme Court and they will too.              But Robert is pursuing the other remedy below. He's filed a       motion in writing to Justice Riopelle to cite the Crown in       contempt of his Order.              As for the surcharge fine, he's filed an application for more       time to pay. He's still waiting for a response.              So every thing he could possibly do has been done.              And I told him that the "no intent" was going to bust him but       it did give him the chance to bring the Crown's dereliction       not only to the attention of the highest court but of the       Crown's bosses in Toronto. So it was a freebie and damaged the       Crown even if it didn't win.              And his motion for contempt will damage the Crown either way       except it should win.
