   JCT: I first met Sharon at the April 1 2014 demonstration on   
   Parliament Hill where we were signing up people to the Gold   
   Star Constitutional challenge with a damages claim. It was   
   during the interval where the Federal Court Chief Justice had   
   stayed all new Statements of Claim. So once Sharon got her   
   Gold Star on her Statement of of Claim and it was stayed, she   
   then filed a Notice of Appeal of the Stay in the Federal Court   
   of Appeal for another Gold Star on the very same day!   
      
   She not only helped people use my kits to fight their own   
   charges but she filed every other kit to the top. The Supreme   
   Court dismissed the applications of all 11 Gold Stars who   
   filed and not wanting to duplicate, she was the only who filed   
   for reconsideration but asked that the relief be applied to   
   all.   
   Sharon Misener succumbed to her cancer a couple of weeks ago   
   and I'd been vexed whether I announce it. If the Crown's   
   watching, they may save the court the decision by moving to   
   strike it because Sharon is now dead. Doesn't need her meds   
   any more. Or keep quiet and see if the Supreme Court deny the   
   medicine to a dead lady or grant the medicine too late for the   
   dead lady.   
      
   So Sharon Misener's motion for reconsideration is now being   
   considered by the Supreme Court of Canada even though she's   
   dead. Kind of proving her point that Phelan should have   
   believed her when she swore she needed it.   
      
   Anyway, I think it's so interesting a situation "DEAD WOMAN   
   STILL ALIVE AT TOP" that I don't care if the Crown finds out.   
   Let them tell the Supreme Court: Skip the decision on the lady   
   who wants her medicine, she just died?"   
      
   But she has asked that the other ten who appealed with her   
   from the Consolidated Appeal below also benefit of any   
   reconsideration she might get:

   RE: Sharon Misener v. HMTQ No. 36991   
      
   Please accept this letter as the Applicant's Motion for   
   Reconsideration of the dismissal of the Application for leave to   
   appeal. Applicant also seeks an order abridging any time for   
   filing or any other irregularity this court may allow because of   
   my medical condition.   
      
   I raise no new facts presuming my medical condition was   
   considered but only raise one important new conclusion from those   
   facts.   
      
   In 2013, Health Canada announced it would no longer be granting   
   any production permits after Oct. 1 2013 with no grow permits   
   after April 1 2014. Patients with expiring MMAR exemptions were   
   instructed to destroy their stored medicine and be exempted with   
   proof of purchase from an MMPR Licensed Producer.   
      
   Though hailed as a reprieve for Canada's cannabis patients, on   
   Mar 21 2001, almost 6 months later, Federal Court Justice Manson   
   granted an injunction extending all grow permits back to Oct 1   
   2013, whether expired or not, but then did not extend all possess   
   permits needed to grow expired or not. Only those not yet expired   
   were extended. Those with expired possess exemptions would not be   
   able to use their grow permits thus cutting almost half of the   
   patients from their affordable supply. Justice Manson dis-   
   exempted over 18,000 medical marijuana patient growers and it   
   didn't make the news. Only a reprieve for half, the Left-Outs   
   unmentioned.   
      
   Later in 2014, 50 Applicants of patients seeking Interim   
   Exemptions pending action in the Federal Court based upon their   
   MMAR permit number as proof of medical need were rejected by   
   Justice Phelan who insisted on seeing more medical evidence upon   
   which he was not qualified to judge.   
      
   The 26 who appealed to the Federal Court of Appeal were   
   dismissed. And the 11 who sought leave to appeal to the Supreme   
   Court were also dismissed.   
      
   During this time, I almost died. I was hospitalized with the   
   recurrence of tumors with no access to oil and only an angel   
   provisioner helped get back on my feet.   
      
   If a doctor had cut off half a hospital's prescriptions based on   
   the dates of their prescriptions, he'd probably be in jail or, in   
   some countries, on death row.   
      
   If a panel of doctors had seen no reason to interfere with his   
   discretion to cut off half the patients for a non-medical reason,   
   they'd probably be with him.   
      
   If the final panel saw no reason to interfere with cutting off   
   half patient medication based on dates, they'd be with them.   
      
   If doctors could not get away with what the courts have done, is   
   that not an indication that courts should not have done it?   
      
   Denying medicine to 18,000 patients is a matter of national   
   importance and the request for interim exemption to again   
   immediately begin growing their affordable medicine is of   
   national importance too.   
      
   I seek an Order granting leave to appeal the refusal to grant me   
   Interim Exemption for insufficient evidence of medical need. In   
   order to avoid much duplication of documentation, should I be   
   granted leave to appeal, I would ask that my fellow Applicants be   
   included in such Order:

   JCT: Justice Michael Phelan found Sharon Misener's sworn   
   testimony on her MMAR exemption number and her cancers   
   insufficient evidence of medical need to satisfy him she needed   
   an exemption for marijuana. Now that Sharon is dead, it seems he   
   blew that medical diagnosis.   
      
   And the Court of Appeal let his deadly decision stand.   
   And the Supreme Court of Canada let that deadly decision stand.   
   And Sharon's dying plea remains alive to reconsider what Phelan   
   and Manson have done to Canada's cannabis-needy patients.   
      
   Please spread word of Sharon's unique contribution to the fight   
   for Repeal. Imagine, still ALIVE even though DECEASED.   
      
   Rest in Party Mode. Heaven must be celebrating the newcomer.
