|    TURMEL: Adrian Stuerm gets rush Montreal    |

From: johnturmel@yahoo.com              JCT: On April 7 2017, Adrian was in St-Jerome Criminal Assizes       court with Justice Marc David presiding. He's the judge who       summarily dismissed Nicola Fontana's Quash motion before Trial       Judge Buffoni presided over his conviction.              He was also the judge setting up the jury trial of Max, Martin       and Eric in Montreal who'd given them quite a berating when he       thought the kits were from the Freemen on the Land.              So again, he blew his cool when Adrian appeared before him       ready to book his jury trial in the same way. Especially when       he found out that Adrian was charged not only with       S.7(1) cultivation that gets him a jury trial but also with       S.5(2) Possession for the Purpose of Trafficking with not       enough quantity to get him a jury trial! So he had to be sent       below to book a second trial while the jury trial was slated       and moved to Montreal. Har har har.              The judge threatened that with such waste of their time, the       court could get angry and they could suffer an "Amusement Tax"       for their good time. Didn't matter, Adrian was going for the       jury trial, it's up to the Crown to duplicate in lower court       or not.              Wow, that's one angle I hadn't thought of. What inconvenience       for them on the same set of facts in two different levels of       court! Har har har. And one the most costly.              So the judge decided to make Adrian hop ordering him to have       all his documentation filed by Tuesday April 11 for his May       8-12 trial including his faxing of the Notice of       Constitutional Question to all provincial Attorneys-General.              So he got it all done. Filed all his documentation, my Expert       Witness Report on the odds of survival hurt by the regimes and       a bunch of patient Will-Says.              He'll be using the witnesses from Max's trial on June 20 but 6       weeks earlier. Taking up two jury trials too. What a way to       end an era, costing them 3 jury proceedings. Imagine if every       grow charge did like Nicola, admit the facts and go to jury.              So Adrian is the next big Mernagh Plus-Why Charter challenge       and it's been set for Montreal with the jury picked before the       challenge, unlike 3 MedPot Musketeers with the Charter       challenge set for hearing before the jury is picked! Same       judge did it two ways. Max before the jury is picked, Adrian       has to sit through selection and waste everyone's time.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
