TURMEL: Adrian Stuerm Release Pending Ap

JCT: In my last post, I included Adrian's Notice of Appeal
against his 6-month conviction and his motion for Release
   Pending Appeal.

I'd told him to ask the jailers for a Notice of Appeal form.
He was told they didn't have any. Wow. You can get them in
Ontario, just ask the warden. But they don't have Appeal forms
in Quebec? Wonder if they're jerking him around.

Since he couldn't sign the documents, after all, he was out of
touch, his wife signed his papers and Ray tried to hand them
in. But the Registry wouldn't take them.

So Caroline visited him on Sunday and handed in his
documentation. He's going to have to get a commissioner to
sign his Affidavit and then hand it to the system and tell
   them to pass it along.

But they wouldn't deliver his documentation on Monday because
it was as holiday! He'd get it Tuesday. Get it signed and
   handed in.

But on Tuesday, he got it late in the afternoon and by then,
the commissioner of oaths was no longer available so he'd have
   to wait until tomorrow.

So tomorrow, he swears his Affidavit and hands it in to his
jailers for transmission to the Court. Should they not have
the machinery for inmates to file appeals, he'll be sending a
signed copy out to Carolyn in case she has to file them
personally now that he signed them. We'll see if they only
   allow regular snail-mail out.

Now, the motion seeks to be heard on Friday May 26 by
telephone. OR SO SOON THEREAFTER AS IT CAN BE HEARD!! "ON
SHORT NOTICE, IF NECESSARY! So, in a sense, it doesn't really
matter when it gets to the court, it's asking for a hearing
any time after May 26 the Court allows. Even if it's filed
   after May 26!

So tomorrow we see how Quebec deals with an inmate appeal when
they say they don't even have the form.
