      From: johnturmel@yahoo.com              JCT: Wednesday May 24, finally, Adrian got his Notice of       Appeal and Motion with Affidavit for release pending appeal       sworn in prison today. And faxed off to the Court of Appeal       and to the Crown Attorney's Office.              The Motion contains the Ali Baba Magic Words: And grant any       Order fixing or allowing anything wrong so justice may be       done."              It's slated for telephonic hearing on Friday. I told Adrian he       only has two cards to play:       1) He's no danger to society;       2) He's no flight risk with job and family.              Remember, those are the criteria for release pending appeal.       So I'd expect him, like me, Ray Turmel, Mike South, Sean       Maloney, to be released pending his appeal. Unless the judge       finds some technicality to keep him in.              And Court of Appeal judges are more genteel than lower judges,       they're farther and longer away from actual contact with law-       breakers. They usually deal with their lawyers, in robes. So       they're rarely mean. Though a Quebec judge once ruled that the       Great Canadian Gambler was such a threat to society that I       should not be released pending my appeal for the 1991       Operation Blackjack raid on Casino Turmel in Hull (Gatineau).       So you never know what a judge considers dangerous.              "Dangerous with a deck of cards" I can live with.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
