From: johnturmel@yahoo.com              JCT: Adrian's wife Caroline got a call from the Quebec Court       of Appeal Registry telling her that the motion for release       pending appeal was lacking the transcript of the judgment.              It usually takes weeks or months to get a transcript unless       you pay a premium for a rush job. The transcript would have       to be ordered Monday and Adrian could be getting out in 2       weeks after 1/6 of his sentence.              Now I'd asked that the transcript be dispensed with. So there       should be a judge signing off on the motion refusing it. So I       called the Registry and found out there was no signed       Direction. When I asked for the name of the judge who refused       to dispense with the transcript, he refused and asked me to       email them explaining why it had to be signed off on by a       judge.              So I did:              John C. Turmel, B.Eng.,       50 Brant Ave.,       Brantford, N3T 3G7,       Tel/Fax: 519-753-5122,       Cell: 519-717-1012       Email: johnturmel@yahoo.com              Friday June 2 2017              Quebec Court of Appeal Registry       courdappelmtl@judex.qc.ca              RE: Adrian Stuerm Appeal No: 500-10-006442-170              I am helping Mr. Stuerm with his appeal paperwork.              Considering Mr. Stuerm's sixth of sentence will probably be       served before the judgment can be transcribed, thus defeating       the whole purpose of the release pending appeal for short       sentences, the motion for release pending appeal did request       that the transcript of the decision be dispensed with.              Mrs. Stuerm has informed me that she was told that the court       insisted the transcript has to be produced before he can have       his hearing.              When I asked Registry Officer Philippe Dupont for copy of the       decision dismissing the motion to dispense with the       transcript, I was informed there is none.              When I asked for the name of the judge who dismissed the       motion to dispense, he refused to give it.              Perhaps the motion to dispense with the transcripts may not       have been noticed but it is there. And since it is the refusal       to dispense with the transcript that is keeping Mr. Stuerm       imprisoned past his probable release, I would request a copy       of an Order dismissing the motion. It no Judgment has yet been       officially made, I would ask for short notice reconsideration       of the motion given the circumstances.              JCT: Asking for reconsideration was a shot in the dark but it       paid off. Around 5pm, Caroline got a call to say that Adrian's       motion would be heard on Wednesday morning. (2 clear days       notice).              I've given Adrian only two things to say:       1) I'm not dangerous;       2) With 4 kids to support, there's no risk of flight.              Sure is nice to see that the judges are human. Plus, granting       the motion to dispense with the transcript eliminates any       future complaints.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
