      From: johnturmel@yahoo.com              JCT: Waylon O'Reilly's grow permit had been stalled 16 weeks       so I made him a motion for interim constitutional exemption       awaiting processing of his permit to start right away and to       grow more plants. Two days after filing, Health Canada       processed and mailed his permit.              But the Judge Roussel dismissed his motion because he should       have filed an application to amend the number of plants;       except that he hadn't received his permit to try to amend yet.       But judge's don't get timelines straight all that often.              So he sent in an application to amend with a letter demanding       the reasons why it takes 16 weeks to process 10 fields of       information. He also urged they be as expeditious now as they       were after he had filed his motion last time. They have not.              So Waylon filed another Federal Court Motion for telephonic       hearing on Monday morning.              File No: T-1078-17        FEDERAL COURT       BETWEEN:        Waylon O'Reilly        Applicant        and               Attorney General of Canada                      APPLICATION UNDER S.18 OF THE FEDERAL COURT ACT                      NOTICE OF MOTION                     TAKE NOTICE THAT on Monday Aug 21 2017, at 10am or as soon       thereafter as the motion can be heard, Waylon O'Reilly will       make a motion to the Court by teleconference.              THE MOTION BEFORE THE APPLICATION FOR JUDICIAL REVIEW IS       FILED IS FOR an Order pending a Judicial Review granting       Applicant interim relief of a personal constitutional       exemption to allow Applicant to:       a) plant 500 outdoor marijuana plants for the 2017 season       b) start planting 49 indoor plants according to the expected       amended ACMPR exemption he has applied for.              AND FOR ANY ORDER abridging the time for service or dispensing       with any documents or amending any error or omission which       this Honourable Court may allow.              THE GROUNDS FOR THE MOTION ARE that 500 tiny plants for the       rest of the outdoor season may yield sufficient crop and that       non-instantaneity of delivery of medication by requirement for       such a long processing time before growing indoors in an era       of instant communications in most other government departments       is a violation of the S.7 Charter Right to Life.              THE FOLLOWING DOCUMENTARY EVIDENCE will be used:       Applicant' Affidavit dated Aug 16 2017       Any other material this court will allow.       Dated at Ottawa on Aug 16 2017.       Waylon O'Reilly               AFFIDAVIT OF WAYLON O'REILLY              I, Waylon O'Reilly, residing at 8 Cercle Grenier in Grenville,       make oath as follows:              1. On July 10 2017, I filed a motion for an Order granting       Applicant interim relief of a personal constitutional       exemption to allow Applicant to plant double the outdoor       marijuana plants according to his 16-week-awaited ACMPR permit       for 19 outdoor plants before the grow season ends pending       final processing of Applicant's ACMPR authorization and       judicial review.              2. Ex. 1 is the ACMPR permit registered and mailed out on July       12 2017.              3. Ex. 2 is the July 27 2017 judgment of Madam Justice Roussel       dismissing my motion to start planting more plants than my       exemption due to the processing delay for not having applied       to amend my permit.              4. Ex. 3 is my Aug 2 2017 letter to Mike McGuire at Health       Canada asking for details of the 16-week processing timeline       and informing him that pursuant to the decision of Justice       Roussel, I was also sending in an application to amend my       exemption to allow me to sow 500 plants for the remainder of       the 2017 season and amend it from "outdoor" to "outdoor-       indoor" and urged similar expedition as after my previous       motion was filed.              5. It would seem evident that such 16- to 20-week processing       times to obtain a permit for medication reduces the patient's       chances of less pain or even survival in violation of the S.7       Charter Right to Life.              ORDER SOUGHT              8. Applicant seems an Order pending a Judicial Review granting       Applicant interim relief of a personal constitutional       exemption to allow Applicant to:       a) plant 500 outdoor marijuana plants for the 2017 season       b) start planting 49 indoor plants according to the expected       amended ACMPR exemption he has applied for.       Dated at ________________ on Aug 16 2017.       _____________________________________       Waylon O'Reilly              JCT: Waylon has how asked to amend his permit from "outdoor"       to "indoor/outdoor." So they stalled his outdoor grow permit       until the season was almost over and now they're stalling his       indoor permit too.              The Crown has today to file a response of some kind looking       for more delay. Otherwise, they get to explain how his       application is doing.
