|    TURMEL: McAmmond files in Fed Crt for Ex    |
|    19 Sep 17 16:07:17    |
From: johnturmel@yahoo.com              JCT: Yesterday, I posted my email to the Justice Ministry       warning the Director General Alain Prefontaine, an old       antagonist, that I would help Dylan file for short notice       relief like I had last time for Ray's exemption renewal being       stalled 8 weeks. Dylan is stalled 14 weeks!              I gave Mr. Prefontaine the chance to duck this one which just       happens to be way worse than Ray's stall.              File No: T-        FEDERAL COURT       BETWEEN:               Robert Dylan McAmmond        Applicant        and        Attorney General of Canada        Respondent               APPLICATION UNDER S.18 OF THE FEDERAL COURT ACT               RECORD OF MOTION                     1. Notice of Motion...............................(2)              2. Applicant's Affidavit..........................(5)                     For the Applicant       Robert Dylan McAmmond       Saskatoon, SK, S7K 3J6              For the Respondent:       Attorney General for Canada              File No:        FEDERAL COURT       BETWEEN:               Robert Dylan McAmmond        Applicant        and        Attorney General of Canada        Respondent               APPLICATION UNDER S.18 OF THE FEDERAL COURT ACT                      NOTICE OF MOTION                     TAKE NOTICE THAT on Tuesday Sep 19 2013, at a time determined       by the Court, Robert Dylan McAmmond will make a motion to the       Court on short notice orally or by telephone or as soon       thereafter as the motion can be heard at the Saskatoon Federal       Courthouse at 520 Spadina Cr. E.              THE MOTION BEFORE THE APPLICATION FOR JUDICIAL REVIEW IS       FILED IS FOR an Order granting Applicant:              1) a personal constitutional exemption to continue growing       marijuana pursuant to the conditions in the expiring ACMPR       permit M??# until the Health Canada delivers the needed       renewal, or, in the alternative,              2) an extension of Applicant's expiring Exemption; or,              3) an Order of Mandamus that Health Canada immediately do its       duty not to violate Applicant's right to life by allowing his       exemption to expire before the renewal is issued and forcing       him to destroy all his medicine and plants while he waits.              AND FOR ANY ORDER abridging the time for service or       amending any error or omission which this Honourable       Court may allow.              THE GROUNDS FOR THE MOTION ARE that taking more than 15 weeks       to renew an exemption when it only took 3 weeks under the MMAR       and forcing the Applicant to choose between concern for the       law and for his health were denounced in R. v. Parker.              THE FOLLOWING DOCUMENTARY EVIDENCE will be used at the       hearing of the motion: Applicant's Affidavit.              Dated at Saskatoon on Sep 19 2017.       Robert Dylan McAmmond,       For the Applicant              TO: Registrar of this Court,       Attorney General of Canada              File No:        FEDERAL COURT       BETWEEN:        Robert Dylan McAmmond        Applicant        and               Attorney General of Canada        Respondent               APPLICATION UNDER S.18 OF THE FEDERAL COURT ACT               AFFIDAVIT OF ROBERT DYLAN MCAMMOND              I, Robert Dylan McAmmond, residing at in Saskatoon, SK, make       oath and say as follows:              1. Ex. A is a copy of my Jun 8 2016 ACMPR exemption to use       marijuana for medical purposes number MCR-1997.              2. Ex. B is my email detailing my situation to John Turmel       which was forwarded to the Director General of Civil Division       at the Ministry of Justice Alan Prefontaine which says:        Mr. Prefontaine:        Here's another renewal being perilously stalled. Could you        make sure we don't go to court?               Dylan McAmmond Today at 3:31 PM        My registration certificate expires this Tuesday        (September 19th). I filed the Statement of Claim and it        was accepted, was told I would be mailed a certified copy        from Federal Court. I'm wondering if you have any advice        as to what I should do. Health Canada has had my renewal        since JUNE 8TH. I have attached a recording to this email,        in which the agent I spoke to said application for renewal        & medical document are filled out fine, no issues what-so-        ever.        Thank you for all your help John.        Robert Dylan McAmmond        Tel: 306.281.9945              3. I sent my permit renewal on June 8 2017 and have been       reassured no problems have been found, my permit expires       today, Sep 19 2017, after more than 14 weeks!              4. In the case of Raymond Turmel T-977-13, his exemption was       expiring that Friday night May 31 2013. His brother John       Turmel wrote up and filed a short notice motion analogous to       mine at 1pm and was granted such short notice hearing by       Justice Roy.              5. At the hearing, the Justice Ministry's Director General for       Civil Litigation Alain Prefontaine explained to Judge Roy that       Dr. Stephane Lessard, Controlled Substances and Tobacco       Directorate didn't understand it. Most Exemptions are done in       under 4 weeks, and renewals, far less; and Dr. Lessard didn't       know what was holding things up.              6.Justice Roy invited the Health Canada officials to appear       before him Saturday morning to explain why they didn't get the       permit renewed on time. It was renewed at 11:30pm May 31 2013.              7. I have been waiting almost 15 weeks for my renewal where it       only took less than 4 weeks under the MMAR. And I'm aware of       new Applicants who have waited up to 28 weeks for process       where it used to take 4 weeks under the MMAR.              28. This Affidavit is made in support of a proposed       Application for Judicial Review seeking declarations that:              1) the failure to renew the ACMPR permit before its expiry       violates the patient's Charter S.7 Right to Life.              2) compelling yearly renewals for those with permanent       diseases violates the Charter S.7 Right to Life.              29. This Affidavit is further made in support of the Interim       Motion for:              1) a personal constitutional exemption to continue growing       marijuana pursuant to the conditions in my expiring ACMPR       permit MCR-1997 until the Health Canada delivers the needed       renewal, or, in the alternative,              2) an extension of Applicant's expiring Exemption; or,              3) an Order of Mandamus that Health Canada immediately do its       duty not to violate Applicant's right to life by allowing his       exemption to expire before the renewal is issued and forcing       him to destroy all his medicine and plants while he waits.              Sworn before me at Saskatoon on Sep 19 2017       Robert Dylan McAmmond                     [continued in next message]              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
