   TURMEL: Health Canada 1-Day Hop-to-It for Beaudoin Medpot Renewal   
      
   JCT: Last Thursday, Denise Beaudoin filed the her Statement of   
   Claim for a declaration that the long processing time for   
   permits violates the patients' Right to Life and for interim   
   relief pending completion of process:   
      
   THE MOTION IS FOR an Order granting Applicant:   
   1) a personal constitutional exemption to continue growing   
   marijuana pursuant to the conditions in the expiring ACMPR   
   permit MCR-3261 until the Health Canada delivers the needed   
   renewal, or, in the alternative,   
   2) an extension of Applicant's expiring Exemption; or,   
   3) an Order of Mandamus that Health Canada immediately do its   
   duty not to violate Applicant's right to life by allowing the   
   exemption to expire before the renewal is issued and forcing   
   Applicant to destroy all plants and stored cannabis.   
      
   In a May 31 213 hearing in Ray Turmel v. Health Canada, Dr.   
   Stephane Lessard, Controlled Substances and Tobacco   
   Directorate, didn't understand why Ray's renewal had taken 8   
   weeks: "Most Exemptions are done in under 4 weeks, and   
   renewals, far less."   
      
   In her motion, she also pointed out the Health Canada Renewal   
   instruction page:   
        It is recommended to submit your renewal application at   
        least 6-8 weeks before the expiry of your current   
        registration certificate.   
      
   So under Harper, an exemption took under 4 weeks and under   
   Justin Trudeau it takes up to 28 weeks. A renewal that took   
   far less than 4 weeks under Harper now it takes up to 16 weeks   
   under Trudeau.   
      
   So it would have been rather embarrassing to have to explain   
   why they were asking people to send in their renewals 6-8   
   weeks in advance when processing took 14-16 weeks.   
      
   So Health Canada got the Motion on Thursday Sep 21 and issued   
   her renewal on Friday Sep 22. Guess the squeaky wheel does get   
   the oil.   
      
   But now they're stuck with the hearing for interim relief   
   which is mooted by their having hopped to it. So Alain   
   Prefontaine's Justice Ministry lawyer Keith Palfram called the   
   court clerk and Ray trying to get the Wednesday hearing   
   cancelled. No problem to abandon the interim relief no longer   
   needed. But continue on with the issue of whether 14-16 weeks   
   for a touted 6-8 week process is an unconstitutional threat   
   to the users which makes the exemption illusory.   
      
   I'd bet that they hop to it for Dylan once he gets his interim   
   relief motion slated now that his Statement of Claim is filed   
   though it wasn't necessary. Big deal.   
      
   We know Dylan's permit was allowed to lapse, thus violating   
   his Charter right to his medicine. I wonder if they'd allow a   
   claim if he really did destroy his plants and his supply. Or   
   is just being put in criminal jeopardy enough to qualify.   
   We'll find out. won't we. And we do remember people who did   
   get busted when HC let their permits expire without renewal.   
      
   I can imagine the thousands of people out there being ill-   
   served by only 34 HC processors. But it's nice to see Health   
   Canada still knows how to hop to it when I make it necessary.   
   Spending the $2 does seem to get you bumped to the top of the   
   pile.
