   JCT: A couple of weeks ago, Tony Van Edig filed a Statement of   
   Claim to declare months for a permit amendment violated his   
   Right to Life by stalling his medicine. We hoped that would   
   have spurred Health Canada them to action but after 2 more   
   weeks, time to ask a judge for interim relief.   
      
                           FEDERAL COURT   
      
      
   TAKE NOTICE THAT on Oct 25 2017, at 9:30am, the Applicant will   
   make a motion to the Court General Sittings at the Federal   
   Courthouse at 90 Sparks St. in Ottawa.   
      
   THE MOTION IS FOR an Order granting Applicant an interim Order   
   for:   
   1) a personal constitutional exemption for a new Designated   
   Grower, Marc Van Edig, to take over growing my marijuana   
   pursuant to my ACMPR permit MCR-23215 until the Health Canada   
   delivers the as-yet-not-delivered-in-13-weeks amended permit,   
   or, in the alternative,   
   2) the requested amendment of Applicant's Exemption to name   
   Marc Van Edig Designated Grower; or,   
   3) an Order of Mandamus that Health Canada immediately do its   
   duty not to violate Applicant's right to life by failing to   
   expedite process of amending Applicant's permit.   
      
   AND FOR ANY ORDER abridging the time for service or amending   
   any error or omission which this Honourable Court may allow.   
      
   THE GROUNDS FOR THE MOTION ARE that taking so many months to   
   change one or two data when it only took 3-4 weeks under the   
   MMAR is an unconstitutional violation of the patient Right to   
   Life.   
      
   THE FOLLOWING DOCUMENTARY EVIDENCE will be used at the   
   hearing of the motion: Applicant's Affidavit.

                   AFFIDAVIT OF ANTHONY VAN EDIG   
      
   I, Anthony Van Edig, residing in Grenville-sur-la-Rouge Quebec   
   make oath and say as follows:   
      
   1. Ex. A is a copy of my ACMPR exemption to use marijuana for   
   medical purposes number MCR-23215.   
      
   2. On July 17 2017, I sent my application to amend my ACMPR   
   permit. Due to health issues, I can no longer grow for myself   
   and applied for my son Marc Van Edig to be my Designated   
   Grower. 13 weeks later, I have not yet received my amended   
   permit. Before my stored supply gets too low, I need my permit   
   for a Designated Grower as soon as possible.   
      
   3. At a hearing before this Court in Raymond Turmel v. HMQ T-   
   977-13 over a delayed renewal of MMAR permit, Justice Roy was   
   informed that Dr. Stephane Lessard, Controlled Substances and   
   Tobacco Directorate had said: Most Exemptions are done in   
   under 4 weeks, and renewals, far less.   
      
   4. The processing of my amended permit has taken well over the   
   4 weeks it used to take under the MMAR.   
      
   5. On Oct 5 2017, I filed a Statement of Claim for a   
   declaration that the processing delay violated my Charter   
   Right to Life.   
      
   6. With no action on my permit after 13 weeks, this Affidavit   
   is made in support of a claim seeking a declaration that the   
   long processing time for amendment of Plaintiff's Access to   
   Cannabis for Medical Purposes Regulations ("ACMPR") Production   
   Permit is an unconstitutional violation of the patient's S.7   
   Charter Right to Life.   
      
   9. This Affidavit is further made in support of the Motion for   
   interim Order for:   
   1) a personal constitutional exemption for a new Designated   
   Grower, NAME, to take over growing my marijuana pursuant to my   
   ACMPR permit MCR-23215 until the Health Canada delivers the   
   needed amended permit, or, in the alternative,   
   2) the requested amendment of Applicant's Exemption; or,   
   3) an Order of Mandamus that Health Canada immediately do its   
   duty not to violate Applicant's right to life by failing to   
   expedite process of amending Applicant's permit.

                      WRITTEN REPRESENTATIONS   
      
   1. Applicant is an ACMPR exemptee to use marijuana for medical   
   purposes number MCR-23215 who sent in my application to amend   
   permit on July 17 2017 and has not received it after 13 weeks   
   of processing time!   
      
   2. Applicant submits that taking 13 weeks to process such   
   amendment to amend a permit which took less than 4 weeks under   
   the MMAR is an unconstitutional violation of the patient's   
   Charter S.7 Right to Life.

   JCT: Last time Waylon O'Reilly, they got his permit to him   
   before the hearing and then tried to get the hearing called   
   off. May try again. Regardless, we're in the kick phase of   
   getting them to hop-to-it. Ottawa Court.
