He was one of the couple of dozen charged in the       Operation Nouage grower ring. He was busted with 174 plants       and charged with selling it to a gang. So he's part of a       "conspiracy!" Har har har. Sad to make light of what       originally sounded like serious charges. But taken in true       context, he's just another small grower with added charge of       whom he sold it to. Har har har. Things would have been so       much better if only he had peddled it on the streets! Mendo and I sent them both copies of the       Parker-Krieger/Hitzig Quash arguments but they're helping       their clients plead guilty. Luc had Mendo.              Luc has been convinced to put up a fight. But being part of       a "criminal gang" meant that his release conditions would be       onerous:       1) No passport, guns, drugs, getting into trouble;       2) 10pm-5am home arrest       3) $12,500 bail.              It also said that a J.P. or judge of provincial court could       vary the condition. I'd always gone to Superior Court to       vary a condition but the Recognizance said that it could be       varied by a judge or Justice of the Peace so I prepared a       Motion to Vary:               APPLICATION TO VARY RECOGNIZANCE              TO AN HONOURABLE JUSTICE OF THE PEACE OR JUDGE OF THE COURT       OF QUEBEC (CRIMINAL CHAMBER) SITTING FOR THE DISTRICT OF       GATINEAU, the Applicant states as follows:              FACTS:              1. Applicant was charged for growing 174 marijuana plants       under       Sections 7-1-2-b, 4-1-4-a, and 5-2-3-a of the CDSA.              2. On Nov 11 2016, Applicant signed a Recognizance posting       Bail of $12,500 and promising to be home between 22:00-5:00       hours every night and other conditions not sought to be       varied.              3. Applicant holds a job which pays about $900/week, about       $3,900 per month.              4. Applicant has fixed expenses for mortgage, auto, Hydro,       Taxes, Communications, credit card payments of about $3,000.              5. With the remaining $900, Applicant must provide for 3       children aged 11, 14, 17 and is getting deeper into debt.              6. The curfew makes visiting family very difficult and       Applicant cannot pick up his kids after 10pm at night.              PART II - ISSUES              Is the Applicant's stability and risk of flight such that       the Bail and Curfew are not necessary.              PART III - ARGUMENT FOR ORDER              7. Given a stable job, stable home situation, and no risk of       flight, Applicant seeks to vary the Recognizance by changing       the $12,500 bail to a $12,500 bond and end the curfew.              Dated at Gatineau on Dec 15 2017.               ________________________________        Luc Paquette               NOTICE OF MOTION              TAKE NOTICE that on _______ 201__ at _____m or as soon       hereafter as can be heard the application made to a judge of       the Superior Court at the Courthouse in Gatineau.              THE MOTION IS FOR AN ORDER varying the Recognizance by       changing the $12,500 bail to a $12,500 bond and ending the       curfew.              AND FOR ANY ORDER abridging any time for service or amending       any error or omission as to form, color, font, margins,       content which the Honourable Justice may allow.              FOR THESE REASONS, MAY IT PLEASE THE COURT OF FIRST INSTANCE       GRANT the present Application.              Dated at Gatineau on Dec 15 2017.       __________________________       Luc Paquette              AFFIDAVIT              I, Luc Paquette, make oath as follows:              1. I hold a stable job as a crane dispatcher taking home       $900/week, about $3,900/month.              2. My records show monthly fixed expenses about $3,000:       1) Mort-gage $1,200       2) Automobile $800       3) Hydro $300       4) Taxes $300       5) Communications $200       6) Credit Card debt $200              3. With the remaining $900, I must provide for 3 children       aged 11, 14, 17. I am getting deeper into debt.              5. The curfew makes picking up my children after 10pm at       night impossible and visiting family very difficult.              6. This Affidavit is made in support of a motion to vary the       Recognizance by replacing the $12,500 Bail with a $12,500       Bond and ending the curfew.              ___________________________________       Luc Paquette              Sworn before me at Gatineau on Dec 15 2017       __________________________________________              JCT: It was Judge Desaulniers again. It seems that Mr. Mendo       had already spoken to the Crown about lifting the curfew for       his Defendants for the holidays until Jan 3 2018 and it       extended to Luc too. But there was no way he was going to       try to get the bail money back.              So Luc decided to present his motion and go for the cash and       no more curfew at all. He laid off Me. Mendo and made his       motion.              Judge Desaulniers pointed out that she did not have the       power to vary it without the consent of the Crown. He       pointed at the Recognizance which said that she or even a       J.P. did have the power to vary the Recognizance. She stated       that it was an error on the form! Without Crown consent, it       had to go to Superior Court.              Fine. So she dropped his curfew until Jan 3. I've re-titled       the motion to Superior Court and sent it to Luc and he'll       get it served and filed early next week. Should be long       before we find out why the Crown thinks holding his cash       better ensures his appearances. Har har har.              I find it hard to see how a judge will think it does. Looks       pretty rosy for a happier Christmas. Even if he just pays       off his credit card. That's almost $200 a month more for the       family.
