      From: johnturmel@yahoo.com              After sending in their medpot renewals 9 weeks ago       (recommended 6-8 weeks before) and with them expiring next       week Wednesday Jan 10 (having to destroy everything), last       Wednesday morning, Tony and Nicole Van Edig filed Statements       of Claim over the stressful delay.              The next day, Thursday, they filed their Motion for Interim       Relief (extend exemption) to be heard at Wednesday Jan 10       General Sittings of Federal Court with the requisite Friday,       Monday, Tuesday 3 days notice. So they waited until the very       last possible moment before filing to see the judge on the       very date of expiry.              In my previous post, I pointed out how Federal Court Justice       Brown had not only slated Delayed Renewers Tony and Nicole       Van Edig for a special telephonic sitting at 2:30pm on the       Jan 10 2018 date their permits expire but had also given the       Attorney General until Monday night Jan 8 to file their       response to the motion to order Court exemptions until the       renewed H.C. exemptions arrive.              That's cutting it close. Ray Turmel's hearing before Judge       Roy happened at 6:30, 5.5 hours before destruction deadline.       Tony and Nicole's happens at 2:30, 9.5 hours before       destruction deadline.              So far, though Luc Lapierre had been told by the lady lawyer       that Health Canada had refused to give his file priority and       he'd have to wait like everyone else but when prodded to get       ready to explain to the judge how many applications were       before his and how long it would take, she got back to him       in hours with news that his exemption had been processed.              The lawyers really don't want to have to explain why the       delay nor how much more delay they'll have to wait. And so       far, they've managed to avoid having to respond by caving       and and hurrying up the processing.              But I can force a written Monday afternoon response just by       making Tony and Nicole unavailable until Tuesday! No       escaping a written explanation. So I told Nicole that when       they called, say there would be no discussion until Tuesday.       Now we'll find out why they spent so much time or....              Sure enough, early Friday, Health Canada called looking for       Tony. Nicole said he wasn't there and they wouldn't say any       more to her. Later, during the afternoon while they were       out, they got back to find two messages:       1) wondering if Tony had received a package yet, and       2) they're try to contact him again.              Why would Health Canada call a Renewal Applicant about a       package delivery? Don't they have a tracking number?              Could it be the letter with the renewed application, what's       with the "package?"              So by Monday, Justice has to provide a written response              1) explaining why H.C. say 6-8 weeks and it's now 10 weeks?       while ducking how long it will take for how many more       applications higher up on the pile?              2) saying that the renewals were delivered by Monday.              So, no ducking the written response. Only picking one of the       two defences to make.
