      From: johnturmel@yahoo.com              TURMEL: Crown consents to McConnell Certiorari to Superior Court              JCT: Tim McConnell was in Quebec Superior Court in Gatineau       trying to over-rule Judge Millar's refusal to annul the       election made by his lawyer Michel Swanston early on and       have the file removed to Superior Court for trial by judge       and jury.              He's sought Triple Extraordinary Remedy: Mandamus (ordering       Millar to rule on the Quash below); Prohibition (delay any       Preliminary Inquiry below mooted when the Superior motion       was stalled and they held it below anyway); and Certiorari       (removing the case to a higher court).              If Certiorari is granted, no need for the other two. If not,       then need for the other two. He got the good information       that the Crown had consented to his annulment. They should       have told Judge Millar when he originally asked.              The ruling of Madam Justice Carole Therrien:              1. Considering the fact that Mr. Timothy McConnell had his       preliminary inquiry on Jan 5 2018 and an order to stand       trial was ordered;              2. Considering the fact that, on Jan 5 2018, Mr. Timothy       McConnell expressed his intention to re-elect before judge       and jury after the audition of the preliminary inquiry;              3. Considering that the Crown has no objection to the       exercise of this re-election;              4. Considering that the Superior Court takes notice of the       new choice of the accused;              JCT: Skipped the part where they set aside the decision of       Judge Millar refusing the allow the annulment and       re-election.              5. Considering the above facts, This court:              Orders The Registration of the election to judge and jury in       the file 550-01-090787-168.              Remands the case to the next opening of the jury session on       April 6th 2018;              Declares that the petitioner's motion has no more object and       is therefore dismissed.              JCT: Granting the Certiorari to over-rule Judge Millar's       dismissal of his motion to annul his election didn't really       come out clearly, almost sounds like the motion lost, but       only after what it asked for was granted. Sneaky but she did       find a way to get Judge Millar out of the embarrassing       situation the Crown let her get into.              So Tim's motion to move the trial from lower court to higher       court was effected even if the motion was dismissed.
