      From: johnturmel@yahoo.com              JCT: Rene Ouellet was in Quebec Superior Court in Quebec City       Monday with his Quash Motion to be dealt with and then his       trial next week on Jan 22.              Remember, when contacted by Ray, he was about to be jailed for       8 months but Ray talked him into changing his plea and       attacking the law.              After a myriad of court adventures, sent up to Superior, sent       back down the Provincial, went back up to Superior then Court       of Appeal to be sent back to Provincial who sent him up to       Superior.              So the Crown offered him a deal with no mandatory jail for the       Production charge if he pleads to the Possession charge.       Problem is it's Possession for the Purpose of Trafficking and       they have no evidence of trafficking.              Even the judge admitted there was no evidence for trafficking.       So tough to plead guilty to it. I told him to ask the judge if       he could plead to the S.4 Possession offence of which he is       obviously guilty and not to the purpose of trafficking of       which he is not.              So Rene is happy having avoided a jail sentence. I just hope       he can plead to the right crime.              Back on Tuesday Jan 24 for his conviction and the judge said       he'd take time to think about sentencing.              And as one medpot accused gets off, another files a Quash       motion in Gatineau today.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
