   I, Sherri Szabados, of the City of Ottawa, in the Province of   
   Ontario, AFFIRM THAT:   
   1. I am employed as a Paralegal in the Legal Services at   
   Health Canada since May 2009. As such, I have personal   
   knowledge of the facts and matters hereinafter deposed to,   
   save and except where any of the following information is   
   stated to be based on information and belief, in which case I   
   verily believe that information to be true.   
      
   3. I am informed by Jon Bricker, Counsel with the Department   
   of Justice, and do verily believe, that he sent a letter to   
   Peter William Howard via email on January 30, 2018, advising   
   Mr. Howard that Health Canada had issued his registration   
   certificate under the Access to Cannabis for Medical Purposes   
   Regulations (ACMPR) and requesting that Mr. Howard abandon his   
   motion. Attached as Exhibit "A" is a copy of the email and   
   letter sent to Peter William Howard on January 30, 2018.   
      
   4. I am also informed by Mr. Bricker and do verily believe   
   that on January 30, 2018, he received a responding email from   
   Peter William Howard, wherein Mr. Howard advised that he "can   
   not abandon this matter as I am not receiving the full term of   
   my prescription with this permit". Attached as Exhibit "B" is   
   a copy of the email received from Peter William Howard on   
   January 30, 2018.

   Wendy Wright is counsel to Her Majesty the Queen in Right of   
   Canada in this matter. She is away from the office until   
   February 5. However, you may direct all correspondence to me   
   until this date, and to Ms. Wright upon her return.   
   I am advised by Health Canada that it has approved your   
   application for registration to produce cannabis for your   
   personal medical use, and that your registration is currently   
   valid. I am also advised that a certificate confirming this   
   registration has been sent to you via registered mail and will   
   arrive shortly.   
   Your motion for interim relief is therefore now moot. In light   
   of this, I ask that you abandon your motion by completing the   
   enclosed Notice of Abandonment. If you wish to discontinue   
   your underlying claim, please also complete and the enclosed   
   Notice of Discontinuance. Once completed, please serve and

                AFFIDAVIT OF BENOIT SEGUIN   
      
   I, Benoit Seguin, of the City of Gatineau, in the Province   
   of Quebec, AFFIRM THAT:   
      
   1. I am employed as the Associate Director of Operations in   
   the Office of Medical Cannabis at Health Canada. My duties   
   include, among other things, collaborating with the team   
   responsible for registering individuals who wish to produce a   
   limited amount of cannabis for  their own medical purposes or   
   designate someone to produce it for them in accordance with   
   the Access to Cannabis for Medical Purposes Regulations   
   (ACMPR).   
      
   2. As such, I have personal knowledge of the facts and matters   
   hereinafter deposed to, save and except where any of the   
   following information is stated to be based on information and   
   belief, in which case I verily believe that information to be   
   true.

   3. On August 24, 2016, the ACMPR were enacted. In addition to   
   providing a framework for the commercial production of   
   cannabis for medical purposes, the ACMPR allows individuals to   
   produce cannabis for their own medical purposes or to   
   designate a person to produce it for them. In the latter case,   
   Health Canada issues a certificate of registration to the   
   person wishing to produce cannabis for his or her own purposes   
   or to the person designated by a patient to produce cannabis   
   for use by the patient.   
      
   4. Within the Office of Medical Cannabis, the Personal   
   Registration Centre (PRC) is responsible for administering and   
   implementing Part 2 of the ACMPR, including the issuance of   
   registrations to individuals. The duties of PRC staff include   
   processing applications and issuing registration certificates   
   for medical cannabis, including the review of new applications   
   for registration and applications to renew or amend existing   
   registrations, as well as keeping records of these activities.   
      
   5. An electronic database is used to keep a record of incoming   
   and outbound correspondence and call logs that were generated   
   in the course of these activities, as well as notes made by   
   Health Canada employees in respect of the activities related   
   to a file.   
      
   6. I am informed by Alexandra Foster, Team Lead of the PRC,   
   and do verily believe, that she reviewed the electronic   
   database for entries related to Peter William Howard and   
   provided the following information and documents:
