|    TURMEL: Judge Order on Harris Motion to     |
|    14 Feb 18 08:35:20    |
From: johnturmel@yahoo.com              JCT: Jeff got an email from the Court with a Direction from       Justice Brown on his motion to amend earlier claims by       updating to the latest ones and for an extension of time to       file a response to Crown's Motion to dismiss damages for       delay Cause of Action A with the Response to the Crown's       upcoming motion to dismiss return of short-changed time       they'll have to answer for the newbies anyway.               Further to the Plaintiff's motion seeking to amend the        Statement of Claim and an extension of time, a direction        was issued by the Court (Brown J.) which states as        follows:        Defendant to file material by Feb 21 2018. Hearing        to be determined after Plaintiff files reply        material, if any.              JCT: Keep in mind, it was nice that the Crown consented to       extending the time to Feb 19 but it was always the judge's       decision and this lets them know. Any extension of time       granted will be after their deadline.              And what are they going to argue? It's better for all the       oldies to file a new Cause B Statement of Claim while they       deal with the newbies with Cause A&B claims anyway? Or all       together for the same everything?              What do you think the judge is going to want.              If they were smart, they'd say which way they want to go, a       supplementary motion to dismiss Cause B or amending the       motion to dismiss Cause A and adding B? And then consent to       the extension of time needed only by the oldies, not the       newbies.              Stay tuned. Heidi filing her Reply today. It's great.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
